25. OVERTIME, SPECIAL DUTIES AND RATES

25.1 An employee directed by an employer to perform any duty before 7 a.m. or after 6 p.m. Monday to Friday inclusive shall be paid at the additional rate per hour of 4% of the minimum remuneration prescribed in clause 18 - Classifications and wage rates for the appropriate classification.

25.2 Subject to clause 24 – Hours of work, an employee who is directed by the employer to work in excess of 38 hours per week shall be paid at the additional rate per hour of 4% of the minimum remuneration prescribed in clause 18 - Classifications and wage rates for the appropriate classification.

25.3 An employee who is specifically directed by his or her employer to work at trade fairs, exhibitions or agricultural shows or to attend sales conferences after 6.00 p.m. Monday to Friday inclusive, shall be paid at the rate per hour of 4% of the minimum remuneration prescribed in clause 18 - Classifications and wage rates for a local traveller, for every hour worked with a minimum payment for two hours.

25.4 Weekend work

An employee who is specifically directed by their employer to perform any work on a Saturday or Sunday, other than attending sales conferences as provided in 25.3, shall be paid as follows for every hour worked with a minimum payment for two hours:

25.4.1 Saturdays - at the rate per hour of four per centum of the minimum remuneration prescribed in clause 18 - Classifications and wage rates for a local traveller.

25.4.2 Sundays - at the rate per hour of 5% of the minimum remuneration prescribed in clause 18 - Classifications and wage rates for a local traveller.

25.5 Attending sales conferences on weekends

A traveller who is specifically directed by his or her employer to attend a sales conference on any Saturday or Sunday shall be paid as follows for every hour attending such sales conference with a minimum payment for two hours:

25.5.1 Saturdays - at the rate per hour of 4% of the minimum remuneration prescribed in clause 18 - Classifications and wage rates for a local traveller.

25.5.2 Sundays - at the rate per hour of 5% of the minimum remuneration prescribed in clause 18 - Classifications and wage rates for a local traveller.

25.5.3 Provided that an employer may require a traveller to attend a sales conference on not more than two weekends in any year without the payment prescribed in this subclause.

25.6 The hourly rates of pay prescribed in 25.3, 25.4 and 25.5 shall be calculated in multiples of 10 cents, amounts less than 5 cents to be taken to the lower multiple, and amounts of 5 cents or more to be taken to the higher multiple.

25.7 Time off in lieu

25.7.1 An employee may elect, with the consent of the employer, to take time off in lieu of payment for overtime at a time or times agreed with the employer.

25.7.2 Overtime taken as time off during ordinary time hours shall be taken at the ordinary time rate, that is an hour for each hour worked.

25.7.3 An employer shall, if requested by an employee, provide payment, at the rate provided for the payment of overtime in the award, for any overtime worked under 25.7.1 where such time has not been taken within four weeks of accrual.

25.7.4 On each occasion that the employee elects to use this provision the resulting agreement shall be recorded in the time and wages records or personnel file or forms appropriate to the enterprise at the time when the agreement is made.
