21.1 Payment for working overtime
Except as otherwise provided by this award, all home care and personal care work excluding shift work performed in excess of 76 hours in a fortnight period shall be payable at the rate of:
21.1.1 time and a half for the first three hours and double time thereafter Monday to Saturday; and
21.1.2 double time all day Sunday.

21.2.1 Subject to clause 21.2.2 an employer may require an employee to work reasonable overtime at overtime rates.
21.2.2 An employee may refuse to work overtime in circumstances where the working of such overtime would result in the employee working hours which are unreasonable having regard to:
21.2.2(a) Any risk to employee’s health and safety;
21.2.2(b) The employees’ personal circumstances including any family responsiblities;
21.2.2(c) The need of the workplace or enterprise;
21.2.2(d) The notice (if any) given by the employer of the overitme and by the employee of his or her intention to refuse it; and
21.2.2(e) Any other relvant matter.
