11. PART-TIME EMPLOYEES

11.1 Part-time employees

11.1.1 An employer may employ part-time employees in any classification in this award.

11.1.2 A part-time employee is an employee who:

11.1.2(a) works less than full-time hours of 38 per week; and

11.1.2(b) has reasonably predictable hours of work.

11.1.3 At the time of first being employed, the employer and the part-time employee will agree, in writing, on a regular pattern of work, specifying at least:

11.1.3(a) the hours worked each day;

11.1.3(b) which days of the week the employee will work;

11.1.3(c) the actual starting and finishing times of each day;

11.1.3(d) variation must be in writing;

11.1.3(e) minimum daily employment is three hours;

11.1.3(f) all time worked in excess of agreed hours is paid at the overtime rate; and

11.1.3(g) the times of taking and the duration of meal breaks.

11.1.4 Any agreement to vary the regular pattern of work must be made in writing before the variation occurs.

11.1.5 The agreement and variation to it must be retained by the employer and a copy given by the employer to the employee.

11.1.6 An employer is required to roster a part-time employee for a minimum of three consecutive hours on any shift.

11.1.7 An employee who does not meet the definition of a part-time employee and who is not a full-time employee will be paid as a casual employee in accordance with 12.1.

11.1.8 All time worked in excess of the hours as mutually arranged will be overtime and paid for at the rates prescribed in clause 25 - Overtime, of this award.

11.2 A part-time employee shall be paid an hourly rate equal to the appropriate weekly rate divided by 38.

11.3 Save for the meal times prescribed, all time between the actual commencing time and the actual ceasing time on any one day shall count and shall be paid for as time worked.
