24. WEEKEND AND LATE NIGHT PENALTY RATES AND LOADINGS

24.1 New South Wales

24.1.1 Saturday

24.1.1(a) All ordinary hours worked by full-time and part-time employees on Saturday shall be paid for at the rate of time and one-quarter.

24.1.1(b) All employees engaged by their employer on or prior to 25th August, 1989 shall continue to be paid for Saturday afternoon work in ordinary time at the employee's penalty rate applicable at that time. No employee shall be disadvantaged by this variation to the award.

24.1.1(c) Casual employees working on a Saturday shall receive the amounts set out in Item 3, of 16.5, by way of a fixed loading in addition to the day's pay.

24.1.2 Sunday

All ordinary hours worked by employees on a Sunday in a shop shall be paid at the rate of time and one half.

24.1.3 The penalties and loadings prescribed in this clause shall not be taken into consideration in calculating any payment for overtime or public holidays, or for any period of sick leave.

24.2 All other states and territories

24.2.1 Saturday

Work rostered during ordinary hours on a Saturday is to be paid at the ordinary hourly rate of pay plus 25% for full-time and regular part-time employees and at the ordinary hourly rate plus 25% plus the casual loading for casual employees.

24.2.2 Sunday

Work rostered during ordinary hours on a Sunday is to be paid at the ordinary hourly rate of pay plus 75% for full-time, regular part-time, and casual employees.

24.2.3 Late nights

Work rostered between 6.00 p.m. and midnight on days other than Saturday, Sunday or Public Holidays; is to be paid at the ordinary hourly rate plus a loading of 10% of the ordinary hourly rate for full-time and regular part-time employees and at the ordinary hourly rate plus 10% of the ordinary hourly rate, plus the appropriate casual loading for casual employees.
