40 - OFFSETTING PAYMENTS UNDER CONTRACT OF EMPLOYMENT

40.1 In application to each employee of Opal Male Grooming, 362 Keilor Road, Niddrie, Victoria, 3042 and Lefan Nominees pty Ltd trading as Petra Hair Care, 241-243 Normanby Road, South Melbourne, Victoria, 3205 who commenced employment prior to 16 March 2000, the employer shall be entitled to offset any amounts paid under the employee’s contract of employment against any amounts payable under this award. For the purposes of this clause all payments made over the period of operation of the award pursuant to the contract of employment may be taken into account for the purpose of limiting any payment due under the award to whatever may be the deficiency between award entitlements for an employee for a period in dispute against the aggregate entitlement under the employee’s contract of employment for any reasonably corresponding period. Provided that this clause shall cease to operate in relation to any employee if and when the contract of employment of that employee is varied at any time after 60 days after the commencement of this award.
