Award simplification; variation of award by consent.

ORDER BY CONSENT

UPON HEARING Mr M. Simpson for the Construction, Forestry, Mining and Energy Union (the CFMEU) and Mr V. Kirkby for CSR Limited (the Company), on 6 July 2000, in relation to a review of the Timber Industry - CSR / CFMEU Wood Panels - Award 1996 (the Award) under Item 51 of Schedule 5 of the Workplace Relations and Other Legislation Act 1996, the COMMISSION NOTES:

[1] that both the CFMEU and the Company consented to the variation of the Award, in conformity with a draft submitted subject to the Commission’s discretion to complete the review;

[2] that having regard to the responses to a statement made by Munro J on 7 February 2001, he is not satisfied that clause 19.4 and Appendices A, B and C of the revised Award reflect properly set minimum rates based on the minimum rates adjustment process and therefore leave is reserved for the parties to apply in order to satisfactorily complete the Item 51 review in relation to that requirement in respect of those provisions;

BUT SUBJECT TO THAT RESERVATION AND PURSUANT TO a provisional decision on transcript on 6 July 2000,

THE COMMISSION ORDERS THAT:

A. The Award shall be varied by deleting all clauses, schedules and appendices and inserting the following:
