8.1 Act means Workplace Relations Act 1996, as amended from time to time.
8.2 Commission means Australian Industrial Relations Commission.
8.3 Continuous Service
8.3.1 Continuous service with one particular employer will not be broken by the following events:
8.3.1(a) absences from work on account of paid leave, which will be taken into account and counted as time worked;
8.3.1(b) the end of a funding period for the service;
8.3.1(c) unpaid absences.
8.3.2 For the purpose of calculating entitlements under this award:
8.3.2(a) absences from work on account of paid leave will be taken into account and counted as time worked; and
8.3.2(b) unpaid absences will not be counted as time worked except where unpaid absences total less than one week in any year of employment.
8.3.3 Where a service is before or after the date of this award, transmitted from an employer (transmittor) to another employer (transmittee) and an employee who at the time of such transmission was an employee of the transmittor in that service becomes an employee of the transmittee:
8.3.3(a) the continuity of employment of the employee will be deemed not to have been broken by reason of such transmission; and
8.3.3(b) the period of employment which the employer has had with transmittor or any prior transmittor will be deemed to be service of the employee with the transmittee.
8.3.4 For the purpose of clause 8.3.3, transmission includes transfer, conveyance, assignment or succession whether by agreement or by operation of law and transmitted has a corresponding meaning.
8.4 Union means the Australian Municipal, Administrative, Clerical and Services Union (ASU).
