25.1 Entitlement
25.1.1 Full-time employees will receive, without loss of pay, to public holidays listed in clause 25.2.
25.1.2 Part-time employees will receive, without loss of pay, to those public holidays prescribed in clause 25.2 which fall on days on which they would ordinarily have been required to work.
25.2 Public holidays applicable to employees under this award
25.2.1 The following public holidays apply to employees under this award:
25.2.2 In addition to the public holidays prescribed in clause 25.2.1, one additional public holiday will apply to each employee in each State or Territory where this award operates as follows:
25.2.2(a) In New South Wales - on a day to be determined each year.
25.2.2(b) In Victoria - on Melbourne Cup Day.
25.2.2(c) In Queensland - on the day gazetted for the local show for the appropriate area.
25.2.2(d) In South Australia - on the third Monday in May.
25.2.2(e) In Western Australia - on Foundation day.
25.2.2(f) In Tasmania - on Regatta Day in Southern Tasmania (i.e., Oatlands and all towns south of Oatlands) and on Recreation Day in Northern Tasmania (i.e., in all towns north of Oatlands).
25.2.2(g) In the ACT - on Canberra Day.
25.2.2(h) In the Northern Territory - on May Day.
25.2.3 Where another day is generally observed in a locality as a substitute for any of the days listed in clause 25.2.1, that day will be observed in lieu of the day provided in clause 25.2.1.
25.3 Substitution of holidays falling on Saturday or Sunday
25.3.1 When Christmas day is a Saturday or a Sunday, a holiday will be observed on 27 December (substitute day).
25.3.2 When Boxing Day is a Saturday or Sunday, a holiday will be observed on 28 December (substitute day).
25.3.3 When New Years Day or Australia Day is a Saturday or Sunday a holiday will be observed on the next Monday (substitute day).
25.4 Additional public holidays
Where in the relevant States, Territories or locality, public holidays are declared or prescribed on days other than those set out in clauses 25.2.1, 25.2.2 and 25.2.3, those days will constitute additional holidays for the purpose of this award.
