9. RELIEVING AND HIGHER DUTIES
9.1 Outdoor employees
9.1.1 Where an employee is required to perform more than one kind of function for any of which a rate is provided higher than his/her usual rate, he/she shall, if he/she works for up to two hours in any one day, be paid at the higher rate for time so worked, and if for more than two hours, he/she shall be paid the higher rate for one day.
9.1.2 Where an employee is moved from his/her usual work to carry out work for which a lower rate of wage is provided than his/her usual rate, he/she shall not be reduced in wages unless the cause of such move is the employee's incompetence, unless the work usually performed by such employees is completed or is held over for more than four working weeks, or being of a seasonal nature is completed for the season.
9.1.3 Employees, notwithstanding their level of classification, can be directed to perform work of a lower classification.
9.2 Indoor employees
9.2.1 An officer directed by the Council or appropriate Divisional Manager to perform the duties at that time pertaining to a higher-classified position for a continuous period of not less than 5 working days shall be paid the minimum salary for the higher-classified position retrospectively to the date of commencing such duties.
9.2.2 An officer directed by the Council or appropriate Divisional Manager to perform part only of the duties pertaining to a higher-classified position for a continuous period of not less than 5 working days shall be paid, retrospectively to the date of commencing that part of those duties, such salary commensurate with its value as may be agreed by the Council and the relevant employee association or as may be determined, in the absence of such agreement, by the Board of Reference.
9.2.3 Payment of higher duties shall be subject to satisfactory completion of the work assigned.
9.2.4 When officers who are in receipt of such payment commence recreational or sick leave, they shall receive any payment to which they are entitled pursuant to this Award at the higher rate of pay if they have been in receipt of such higher rate of pay continuously for three calendar months or more immediately preceding the taking of recreational or sick or accident leave.
9.2.5 Employees who are performing higher duties shall receive higher duties for the public holiday only if the said public holiday falls within the period of higher duties.
9.2.6 When an officer on higher duties performs overtime completing the duties of the higher classified position, payment shall be at the higher rate of pay.
9.2.7 Where five or more accumulated RDOs have been added to any approved leave then payment of higher duties for the RDO component shall be paid at the discretion of the Divisional Manager. Part payment may be made when less than full responsibility is accepted.
