30. LONG SERVICE LEAVE

30.1 An employee who has served the Council continuously as an employee shall be entitled to leave of absence on full salary as follows:

30.1.1 After ten years’ continuous service – ninety calendar days.

30.1.2 Nine calendar days for each completed year of service in excess of ten years. If the leave due under subclause 30.1.1 has not been taken, an employee, upon completing a total of twenty years’ service, shall be entitled to one hundred and eighty calendar days’ leave on full salary.

30.2 For long service leave purposes salary means the amount to which the employee would have been entitled as salary if he/she had worked without overtime for the period he/she is actually on leave.

30.3 Any period of long service leave granted under this award shall be in addition to any statutory or gazetted public holidays or any other days which are proclaimed public holidays or normally observed by the Council as holidays.

30.4 Long service leave is to be taken only at such time as the work of the Council will permit and as the Council may determine. It shall not be permitted to accumulate beyond six months, unless by a decision of the Council and then only for departmental reasons. Long service leave shall not, without the approval of the General Manager, be taken in periods of less than ten days.

30.5 Pro-rata long service leave will be paid to employees who have completed eight years’ continuous service and who leave Council for one of the following reasons:

30.5.1 death - in this case the benefit will be paid to the employee’s personal representative or dependant/s

30.5.2 medical grounds, with the consent of Council

30.5.3 the employee’s service is terminated because his/her position has been made redundant

30.5.4 the term of appointment has expired

30.5.5 the employee’s service is no longer needed.

30.6 If an employee with ten years’ service or more is terminated for any reason or in the event of death, then payment according to clause 30.1 shall be paid to the employee or legal representative (in case of death).

30.7 In determining length of service for long service leave purposes, service in a Council or other body taken over by the City of Launceston shall count as service with the Launceston City Council.

30.8 Where an employee is granted leave of absence (other than for the purpose of service as a member of any of Her Majesty’s Naval, Military or Air Forces) whether with or without pay for any period of or exceeding 65 working days, the period during which that employee is absent from duty on the leave so granted shall not be included as part of the period of service as an employee for the purpose of calculating long service leave, but the absence shall not be considered to break the continuity of service.
