11. SALARY RANGES AND PROGRESSION
11.1 Salary Scales

11.1.1 The following salary scales shall be the minimum salaries that apply to employees under this award:

11.1.2 Arbitrated safety net adjustment

The rates of pay in this award include the arbitrated safety net adjustment payable under the Safety Net Review—Wages June 2005 decision [PR002005]. This arbitrated safety net adjustment may be offset against any equivalent amount in rates of pay received by employees whose wages and conditions of employment are regulated by this award which are above the wage rates prescribed in the award. Such above-award payments include wages payable pursuant to certified agreements, currently operating enterprise flexibility agreements, Australian Workplace Agreements, award variations to give effect to enterprise agreements and over-award arrangements. Absorption which is contrary to the terms of an agreement is not required.
Increases made under previous National Wage Case principles or under the current Statement of Principles, excepting those resulting from enterprise agreements, are not to be used to offset arbitrated safety net adjustments.
11.2 A Vocationally registered general practitioner as defined in clause 4 - Definitions of this award shall be appointed at no less than Level 6.
11.3 A Vocationally registered general practitioner as defined in clause 4 - Definitions, of this award with additional post-graduate medical qualifications or medical skills as required by the employer; or a Medical Practitioner or Vocationally Registered General Practitioner in charge of one or more Medical Practitioners shall be paid at no less than Level 9.
Provided that in assessing the actual level of recruitment and positioning in the salary structure, full consideration will be given to the skills, qualifications and experience of the employee, as well as the unique needs of the community and the ability of the employer to attract, recruit and retain doctors having regard to the location and working environment of the employer.
11.4 A Medical Officer shall be eligible for annual advancement in the salary range subject to the Medical Officer having acquired additional professional skills and knowledge and applying those skills and that knowledge in the workplace provided that, in the case of non-Vocationally Registered medical practitioners, such salary progression shall be to a maximum of Level 6.
11.4.1 This could be demonstrated in ways such as by the Medical Officer having met, and continuing to meet, the training, clinical experience, competency, accreditation and certification requirements set down from time to time by the relevant learned medical college or relevant postgraduate medical training authority.
11.4.2 The employer may defer or refuse to advance a Medical Officer on the incremental scale if the criteria set out in this subclause are not met by the Medical Officer. A Medical Officer whose incremental advancement has been refused or deferred may seek to have the decision reviewed through the dispute settling procedure in clause 7 of this award.
