PART 4 – LEAVE OF ABSENCE
13. ANNUAL LEAVE
13.1 At the end of each year of employment an employee is entitled to four weeks' annual leave on full pay exclusive of any statutory holiday, which may occur during the period of that annual leave.
13.2 Notwithstanding the entitlement in subclause 13.1 above, annual leave of five weeks per year will apply to employees serving in the northern and western part of the State, comprising all that part of the State lying to the northward or westward of a line drawn westward from St Lawrence to the 144th meridian of east longitude and thence southward along that meridian to the southern boundary of the State, but not deemed to comprise St Lawrence.
13.3 Payment during annual leave shall be at the same rate applying immediately prior to going on leave and shall be paid in advance of such leave.
13.4 For staff appointed for a fixed term, all annual leave, which will accrue in respect of the appointment, shall be formally applied for and taken by the employee during the term of the appointment. Provided that if during an appointment of less than one year there has been no opportunity for the employee to take all recreation leave accrued in respect of the appointment, the employee shall, on expiry of the appointment, be paid the cash equivalent of the recreation leave or pro rata recreation leave due.
13.5 Annual leave may not accumulate for more than two years entitlement without the approval of the University.
13.6 The University may direct an employee to take recreation leave at any time after the employee has accumulated the maximum permissible.
13.7 Unused annual leave shall be available as sick leave.
13.8 If the employment of any employee is terminated before the expiration of a full year of employment, the employee shall be paid, in addition to all other amounts due to the employee, an amount equal to one-twelfth of the ordinary pay for the period of employment if such employee is entitled to an annual holiday on full pay for four weeks and one-ninth of the ordinary pay for the period of employment if such employee is entitled to an annual holiday on full pay of 5 weeks, calculated in accordance with subclause 13.9 below.
13.9 Annual leave loading
13.9.1 Employees are entitled, on a payday preceding 1 January, to an annual leave loading equal to 17-1/2 per cent of salary for the period of leave accrued with a maximum payment equal to the Australian Bureau of Statistics’ average weekly total earnings of all males - (Australia) for the August quarter preceding the date of accrual.
13.9.2 Employees whose employment commences after 1 January in any year will be entitled on a pay day preceding the following 1 January, to a pro rata annual leave loading for the number of completed months of continuous service in that year, provided that the maximum payment as set out in sub-clause 13.9.1 is in the proportion that such number of months bears to twelve months.
13.9.3 Employees whose employment is terminated prior to 31 December in any year will be entitled to a pro rata annual leave loading for the number of completed months of continuous service in that year, provided that the maximum payment as set out in sub-clause 13.9.1 is in the proportion that such number bears to twelve months.
13.9.4 Notwithstanding the provisions of this clause, the maximum payment specified in sub-clause 13.9.1 will not apply to employees employed at Queensland University of Technology, Central Queensland University, University of Southern Queensland Australian Catholic University, and Griffith University.
