30. SHIFT WORK

30.1 Transfer to existing shift rosters

Until the expiration of 48 hours’ notice of the specified shift on which he/she or she is to work, an employee will:

30.1.1 if immediately previously employed on seven-day shift work, be paid at the rate of double time;

30.1.2 if immediately previously employed on other shift work, or day work, be paid at the rate of time and a half for the first two hours and double time thereafter.

30.2 Variation of method of working shifts

The method of working shifts and/or the times of commencing and finishing shifts, once having been determined, may, in any case, be varied by agreement between the employer and a majority of employees to suit the circumstances of the establishment or, in the absence of agreement, by 48 hours’ notice of variation given by the employer to the employee, or employees.

30.3 Shift allowances

A shift worker engaged on shifts will, for the ordinary hours of such shifts, be paid the following extra percentages of his/her respective rate of pay:

The above percentages will not be applied to the payment for any shift in any case where the shift worker is entitled to receive the extra rates prescribed in 12.3 or 12.6 of clause 26 - Saturday and Sunday work or 30.4, or 36.3 of clause 36 - Holidays.

30.4 Rostered day off

30.4.1 A seven-day shift worker, whose rostered day off falls on a weekday holiday (as per clause 36 - Holidays) and is not required to work, will receive eight hours’ pay at his/her ordinary-time rate in addition to his/her weekly wage.

30.4.2 For all work performed on his/her rostered day off, a seven-day shift worker will be paid at the rate of double time with a minimum payment of four hours provided that the provision for a minimum payment will not apply where the work on such day is continuous with the commencement, or completion, of the employee’s ordinary shift.

30.5 Summer time

30.5.1 Notwithstanding anything contained elsewhere in this award, in any area where, by reason of the legislation of a State or Territory, summer time is prescribed as being in advance of the standard time of that State or Territory, the length of any shift:

30.5.1(a) commencing before the time prescribed by the relevant legislation for the commencement of the summer time period; and

30.5.1(b) commencing on, or before, the time prescribed by such legislation for the termination of the summer time period;

30.5.1(c) will be deemed to be the number of hours represented by the difference between the time recorded by the clock at the beginning of the shift and the time so recorded at the end thereof, with the time of the clock in each case to be set to the time fixed pursuant to the relevant legislation of the State or Territory.

30.5.2 In this subclause the expressions standard time and summer time will bear the same meaning as are prescribed by the relevant legislation in the State or Territory.
