AP824076 - Australian Government Employment – Conditions and Salaries Award 2003

3. DEFINITIONS

For the purposes of this award:

3.1 Agency means the relevant employing authority;

3.2 CEO means the Chief Executive Officer of the relevant body as defined in its enabling legislation;

3.3 AIRC means the Australian Industrial Relations Commission;

3.4 Dependant in relation to an employee, means:

3.5 Employee means an officer or temporary employee as defined, who occupies a classification or performs work specified in this award;

3.6 Partner means, in relation to a person who is a member of a couple, the other member of the couple;

3.7 Salary barrier means classifications are “below” the salary barrier where the minimum rate for the classification is less than the minimum rate payable to a Senior Officer Grade C; classifications are “above” the salary barrier where the minimum rate is not less than the minimum rate payable to a Senior Officer Grade C;

3.8 Spouse in relation to an employee, includes a de facto spouse. A de facto spouse means a person of the opposite sex to the employee who lives with the employee as the husband or wife of that person on a bona fide domestic basis;

3.9 Temporary employee means a person engaged on a temporary basis under the enabling legislation of the relevant body;

3.10 Union means a union party to this award, and where appropriate, includes the relevant national union official or nominated delegate;

3.11 Relevant union is a union which can represent the industrial interests of the employees concerned and has members employed in the agency.
