15. EXPENSE RELATED ALLOWANCES

15.1 Overtime meal allowance

15.1.1 No meal break

Subject to 15.1.5 an employee who works overtime after the end of ordinary duty for the day, to the completion of or beyond a meal period, without a break for a meal, will be paid a meal allowance of $19.15 in addition to any overtime.

15.1.2 Meal period

A meal period will mean the following periods:

15.1.2(a) 7.00 a.m. to 9.00 a.m.;

15.1.2(b) 12 noon to 2.00 p.m.;

15.1.2(c) 6.00 p.m. to 7.00 p.m.; and

15.1.2(d) midnight to 1.00 a.m.

15.1.3 Local arrangements

Substituted meal periods may be utilised upon agreement between the CEO and the majority of affected employees in the agency. Such an agreement will provide for four meal allowance periods in each 24-hour cycle.

15.1.4 Meal break

Subject to 15.1.5, a meal allowance is also payable to an employee who:

15.1.4(a) is required, after the completion of the employee’s ordinary hours of duty for the day, to perform duty after a break for a meal which occurs after that completion and is not entitled to payment for that break;

15.1.4(b) is required to perform duty before the commencement of ordinary hours of duty, who breaks for a meal and is not entitled to payment for that break; or

15.1.4(c) is required to perform duty on a Saturday, Sunday or public holiday, in addition to the employee’s normal weekly hours of duty, extending beyond a meal break and is not entitled to payment for that meal break.

15.1.5 Where a three course meal is obtainable by the employee at a canteen, cafeteria or dining-room conducted, controlled, or assisted by the employer, the amount of meal allowance will be the maximum amount for which a three course meal is obtainable at the canteen, cafeteria or dining-room. The rate payable under this paragraph is in substitution for the rate at paragraph 15.1.1.

15.2 Veterinary officers – district allowance

Veterinary officers in grades 1 and 2 shall be entitled to the district allowance prescribed in this subclause when serving in localities classified for the purpose of district allowances.

15.2.1 Eligibility for district allowance

An employee residing in a locality listed in Table 15.2A is entitled to be paid district allowance.

15.2.1(a) An employee in receipt of field allowance is not entitled to the provisions of this subclause.

15.2.1(b) An employee may, where the employee is in receipt of travelling allowance be paid district allowance in addition to travelling allowance while temporarily stationed in a locality that would normally attract the payment of district allowance where the CEO considers this appropriate.

15.2.1(c) The CEO may increase the travelling allowance payable in such a locality.

15.2.2 Rates of district allowance: The annual rate at which district allowance is payable to an employee is specified at Table 15.2B.

15.2.3 Eligible dependant/eligible partner: is a dependant or partner who resides with the employee, and whose income, if any, is less than $14,363 per annum.

15.2.3(a) An employee with a spouse or partner who is also entitled to the payment of district allowance under this subclause will be regarded as an employee without dependants for the calculation of district allowance.

15.2.4 District allowance during annual leave

Where an employee is entitled to the payment of district allowance on the day immediately prior to the commencement of a period of annual leave, the payment of district allowance will continue during the annual leave, irrespective of where the employee resides during the leave.

15.3 Excess travelling time

15.3.1 Excess travel

An employee who is travelling or on duty away from the employee's usual place of work will be paid for time necessarily spent in travel or on duty (exclusive of overtime duty) in excess of:

15.3.1(a) the employee's usual hours of duty for the day; and

15.3.1(b) the time necessarily spent travelling to and from home and the usual place of work.

15.3.2 Minimum time: Payment will not be made unless the excess time exceeds:

15.3.2(a) one half hour in any one day; or

15.3.2(b) two and one half hours in any fortnight

nor will payment be made for more than five hours in any one day.

15.3.3 Rate: The rate of payment will be:

15.3.3(a) single time on Mondays to Saturdays; and

15.3.3(b) time and a half on Sundays and Public Holidays.

15.3.4 Employees in receipt of a salary exceeding $34,720 will not be entitled to payment for excess travelling time.

15.3.5 Usual place of work

Where an employee’s usual place of work is variable within a specified district, the CEO will determine the usual place of work. In this case a minimum of twenty minutes travelling time each way will apply.

15.3.6 Excess Fares: An employee will be entitled to the reimbursement of excess fares incurred by the employee performing duty temporarily at a place other than the employee’s usual place of work, when the cost of travelling to and from the temporary place of work is greater than the cost of travelling to and from the employee’s usual place of work.

15.3.6(a) An employee in receipt of travelling allowance or reimbursement of fares under the relevant Commonwealth authority will not be paid an allowance under 15.3.6 Excess Fares.

15.3.6(b) An employee who has been notified in writing to proceed to a place of work in anticipation of a permanent relocation to that place of work will not be paid an allowance under 15.3.6 Excess Fares.
