SCHEDULE A - TRANSITIONAL PROVISIONS FOR EXISTING EMPLOYEES

A.1 EMPLOYEES COVERED BY FORMER PAID RATES AWARD

The provisions of this Schedule only apply to an employee whose terms and conditions of employment were governed by this award immediately prior to 22 August 2002, (the date the award was converted from a paid rates award to a minimum rates) – an ‘eligible employee’.

A.1.1 Where an eligible employee had an award entitlement to a higher award salary rate immediately prior to the date this award was converted to a minimum rates award, that higher rate will apply. The following provisions of this Schedule set out the pay rates, which applied, and the associated provisions, which determined the appropriate pay point for employees. By applying these provisions to eligible employees, the award pay rate, which applied to an employee immediately prior to 22 August 2002 can be determined. Where the award salary rate determined in accordance with this Schedule is higher than that otherwise applying under the general award provisions, it will apply to an eligible employee while the rate remains beneficial to the employee. Where a pay rate in this Attachment is lower than the relevant minimum rate in the award, the rate has an asterix shown against it (ie. it is no longer beneficial to eligible employees).

A.2 SALARY RATES

A.2.1 Classifications and Rates of Pay

All employees performing work within the classifications listed in the Tables in this clause, will be paid annual salary at no less that the minimum rate adjacent to the relevant classification set out in the Table.

A.2.2 No adjustment of rates

In accordance with the Paid Rates Decision of 20 October 1998 [Print Q7661], any future increases in salary rates in the award will not apply to the rates in this Schedule.

A.2.6 Advancement

A Professional Officer Class 1 and a Academic Level 1 shall be advanced to the third salary point if he or she possesses a degree or diploma which, in the opinion of the CEO, was appropriate for the duties of the position and the minimum period of full time study for which was not less than three years.

A Professional Officer Class 1 and a Academic Level 1 shall be advanced to the fourth salary point if he or she possesses a degree or diploma which, in the opinion of the CEO, was appropriate for the duties of the position and the minimum period of full time study for which was not less than four years - A2.5.

A Professional Officer employed as a Marine Surveyor or Marine Education Officer shall be paid no less than the first salary point of the Professional Officer Class 2.

A Professional Officer Class 1 employed as a Land Surveyor or Surveyor shall be advanced to the firth salary point if he or she possesses a licence or registration as a Surveyor in an Australian State or Territory and holds a degree or diploma or an Australian tertiary institution, or a comparable overseas qualification, which, in the opinion of the CEO, is appropriate to the duties of the position and the minimum period of full-time study for which is three years; or a Certificate of Competency for the Surveyors Board of an Australian State or Territory.

A Professional Officer Class 1 employed as a Land Surveyor or Surveyor shall be advanced to the sixth salary point if he or she possesses a licence or registration as a Surveyor in an Australian State or Territory and meets the requirements of A.2.5.

A.3 INCREMENTS

A3.1 Frequency of increments

An employee was, prior to [date of variation], entitled to progress one pay point within the pay scale for the employee’s classification after twelve months of service at a particular pay point. This incremental progression was subject to:

A3.2 Promotion and higher duties allowance

An employee who was promoted would have included for the purpose of calculating the increment date, any previous period during which the employee acted at the new classification (or a higher classification). This is subject to the provisions of A.4.1.2 and A.4.1.3. This applied whether or not the employee was performing duties at the new level at the time of promotion.

A3.3 Juniors

The provisions of A3.1, A3.4 and A3.8 will not apply to an employee under 21 years of age in a classification where rates of salary are prescribed according to age, except where an employee was paid the adult salary rate following automatic advancement upon successful completion of a course of study or training.

A3.4 Deferral of increments

The CEO may have directed in writing that an increment would not be paid to an employee for a period specified, provided that:

A3.5 Direction for deferral

Where the CEO made or varied a direction for deferral of an increment, payment of that increment was deferred until the end of the period specified in the direction.

A.3.6 Statement of reasons

Where the CEO made or varied a direction for deferral of an increment, a copy of that direction and a statement of the reasons for such action was to be provided to the employee.

A.3.7 CEO variation – payment

Where an increment was deferred for a period not exceeding six months, the CEO may have granted the next increment that would have been paid from the original date of incremental advancement.

A3.8 Temporary employees

Unless specified below, employees engaged on a temporary basis are subject to the provisions of clauses A3 and A4.

A3.8.1 Broken service

Where an employee performed duty in broken period, previous service was only to be taken into account where:

A3.8.2 Retention of increments

An increment granted under the provisions of A3.8.1 was retained for all further service at that level, provided that an employee who performed no duty at that or a higher classification for two consecutive years reverted to the minimum of the range for subsequent employment.

A.4 ALLOWANCES

A4.1 Higher duties allowance

A4.1.1 Continuous higher duties – increments

Where an employee had been paid higher duties for twelve months or more continuously at a particular pay point (or higher), an increment was due in accordance with the provisions of clause A.3.

A4.1.2 Broken higher duties – increments

Where an employee performed higher duties in broken periods, an increment was due when an employee has been paid for twelve months higher duties at a particular pay point (or higher) classification in a 24 month period.

A4.1.3 Retention of higher duties increments

After an increment had been attained according to paragraphs A4.1.1 and A4.1.2, it was retained for future higher duties at that classification level provided that an employee who had not been paid higher duties at that classification level (or higher) for two consecutive years, reverted to the minimum of the range for any subsequent higher duties.

A4.2 Excess travelling time

A person employed immediately before this award was varied to become a minimum rates award, and who is in receipt of a salary which exceeds the second salary point of an Administrative Service Officer class 4 is not entitled to payment for excess travelling time.
