10.1 Weekly employees
10.1.1 The ordinary hours of work exclusive of meal hours shall not exceed an average of 38 hours per week and shall be worked between the hours of 7.00 a.m. and 6.00 p.m., Monday to Friday inclusive, in one of the following ways:
10.1.1(a) on 19 days over a 4 week cycle; or
10.1.1(b) on 10 days over a 2 week cycle; or
10.1.1(c) on 5 days in any week.
Where the employer and the employee agree, rostered days off, which occur as a result of employees working in accordance with the provisions of this subclause, may accumulate to a maximum of 5 days. These accumulated days may be taken at any time mutually agreed between the employer and employee and shall be taken within six months of accrual.
Notwithstanding any other provision of this award, the ordinary hours of work prescribed herein may be worked up to 10 hours on any day. Provided that in any arrangement of ordinary working hours where the ordinary working hours are to exceed 8 on any day but no more than 10, the arrangement of hours shall be subject to the agreement of the employer and the majority of employees concerned.
10.1.2 Where a 19 day/4 week cycle is worked, the ordinary hours of work shall not exceed 8 hours per day, Monday to Friday inclusive, between the hours of 7.00 a.m. and 6.00 p.m.
10.1.3 Where a 10 day/2 week cycle is worked, the ordinary hours of work shall not exceed 8 hours per day, Monday to Friday inclusive, on 9 days of the cycle and 4 hours on any one day of the cycle, between the hours of 7.00 a.m. and 6.00 p.m.
10.1.4 Where a 5 day week is worked, the ordinary hours of work shall be worked between the hours of 7.00 a.m. and 6.00 p.m., Monday to Friday inclusive, such that either:
10.1.4(a) the ordinary hours of work on 4 days of any one week shall not exceed 8 hours and on one day of the week shall not exceed 6 hours; or
10.1.4(b) the ordinary hours of work on each day of the week shall not exceed 7 hours and 36 minutes.
10.1.4(c) The starting time once fixed in accordance with this subclause, shall not be altered without seven days notice being given by the employer to the employees. However, in an emergency, the employer and an employee may agree to change such employee’s commencing and ceasing times with less than seven days’ notice, provided that the employee shall be entitled to have the union delegate present when such matters are discussed.
10.2 In circumstances where a prearranged change in the normal hours worked by an employee (altering his/her ordinary starting and finishing time) requires an employee to work outside the spread of hours of this clause, such work performed outside the spread of hours will not attract penalty rates but will attract the appropriate shift allowances.
10.3 Meal breaks shall be for a period of not less than 30 minutes and not more than 60 minutes. Provided that no employee shall be required to work for a longer period than 5 hours without a meal break unless by mutual agreement between the employer and the employee concerned.
10.4 Casual employees
The spread of ordinary hours of work, exclusive of meal times, shall be the same as those prescribed for weekly employees.
10.5 Part-time employees
The spread of ordinary hours of work, exclusive of meal times, shall be the same as those prescribed for weekly employees.
