16. ANNUAL LEAVE

16.1 Period of leave

A period of 20 days paid leave shall be allowed annually to an employee after 12 months’ continuous service. In respect of annual leave, payment for day workers shall include a sum equivalent to an additional 20 per cent of their normal salary and in the case of shift workers, a sum equivalent to their normal salary and shift penalties which would have fallen due according to his/her roster, whichever is the greater. Arrangements for taking leave shall be established by mutual consent. The above provisions apply on a pro rata basis on termination of employment.

16.2 Proportionate leave on termination

If an employee leaves the employment of the employer after one month’s continuous service in his/her first qualifying 12 monthly period with the company, the employee shall be paid as follows:

16.2.1 If he or she had been employed as a seven day shift worker for the whole of the period for which he or she is entitled to proportionate leave at his/her ordinary rate of wage plus an amount equal to 20 per cent thereof for 16-2/3 hours at the same rate in respect of each completed month of continuous service, the service being service in respect of which leave has not been granted hereunder.

16.2.2 If he or she had been employed as a seven day shift worker for part only of the period for which he or she is entitled to proportionate leave, at the rate prescribed in 20.5.1 hereof, plus 3-1/3 hours for each month he or she was continuously employed as a 7 day shift worker.

16.3 Timing of leave

By agreement with the employer and employee, annual leave may be taken at any time within a period of 24 months from the date at which it falls due. An employee may elect, with the consent of the employer, to take annual leave in single day periods or part of a single day not exceeding a total of 10 days in any calendar year at a time or times agreed between them.
