30. HOURS OF WORK

30.1 Spread of hours and penalties

The ordinary hours of work shall be 38 per week.

30.1.1 Ordinary hours may be rostered at any time on any day Monday to Sunday.

30.1.2 For all time worked between the spread of hours set down for Sunday in 30.1.1, and where the hours worked fall within the employees 38 hour week, a 50% loading shall apply.

30.1.3 For all time worked outside of the spread of hours appearing in 30.1.1, and where the hours worked fall within an employees 38 hour week, the following loadings shall apply.

30.1.3(a) Midnight until 5.00 a.m. Monday to Saturday; 6.00 p.m. until Midnight, Saturday - a 30% loading.;

30.1.3(b) Midnight until 7.00 a.m. and 6.00 p.m. until midnight Sunday - a 100% loading.

30.1.4 Casuals are entitled to ordinary time penalties in addition to the 20% casual loading.

30.2 Limit of ordinary hours

30.2.1 Ordinary hours shall not exceed:

30.3 Work rosters

This paragraph is subject to the provisions of clause 31 - Operation of 38-hour week.

30.3.1 No full-time or part-time employee shall work more than twenty ordinary time starts in any period of four consecutive weeks. No full-time or part-time employee shall work more than eleven ordinary time starts in any period of two consecutive weeks. Where an employee works on six consecutive ordinary time starts in a week, the employee shall be allowed two consecutive days off work unless otherwise agreed between the employer and the employee.

30.3.2 If, as a consequence of changes to an employer’s legislated, exempted or proclaimed trading hours work rosters of an existing full-time or part-time employee determined by an employer pursuant to this clause are varied, such rosters should be determined by the employer in consultation with the individual employee or the union.

30.3.3 Full-time and part-time employees must be provided in advance with regular notice of their work rosters. Notice of any change of rosters for full-time and part-time employees shall be given at least one week prior to the change unless the employer and employee mutually agree to a lesser period of notice.

30.4 Savings provision for South Australian employees

30.4.1 Any employee who was not employed on Sundays or on more than one late night per week will have the right to refuse work in ordinary time on Sundays and on more than one late night in each week.

30.4.2 This provision shall remain in force for a period of two years from the commencement of this award and shall be renegotiated at the expiration of this award.

30.5 Interview Time

An employee appointed Union Delegate shall upon notification thereof to their employer, be recognised as the accredited representative of the Shop Distributive and Allied Employees Association or the Australian Liquor, Hospitality an Miscellaneous Workers' Union (Baking and Sales Section) and shall be allowed reasonable time during working hours to interview the employer or their representative on matters affecting employees they represent.
