34. OVERTIME ON SUNDAYS OR ON PUBLIC HOLIDAYS

34.1 Subject to this clause, where an employee works overtime on either a Sunday or on a public holiday, the employee must be paid at the rate of double time for all work so performed.

34.2 Notwithstanding 34.1 employees employed in the Northern Territory who work overtime on a public holiday must be paid at the rate of double time and a half.

34.3 The basis for calculating overtime rates to be paid under this clause for full-time and part-time employees shall be the appropriate weekly rate prescribed by clause 19 - Wages of this award, divided by 38 and rounded off to the nearest cent, then multiplied by the appropriate penalty.

34.4 The basis for calculating overtime rates to be paid under this clause for casual employees shall be the appropriate weekly rate prescribed by clause 19 - Wages of this award, divided by 38 as increased by 20%. This result shall be rounded off to the nearest cent then multiplied by the appropriate penalty.
