5. HOURS OF WORK

5.1 Butchers/apprentice butchers

5.1.1 The ordinary hours of work for Butchers and Apprentice Butchers shall be as prescribed by clause 30 - Hours of work of Part 1 of this award with the following exception:

5.1.2 Those Butchers and Apprentice Butchers in who were working on a Sunday prior to the operation of this award shall continue to be paid at overtime rates for work performed on a Sunday. The 38 hour week shall be worked between Monday to Saturday inclusive.

5.2 Bakers/pastrycooks and apprentice bakers/pastrycooks

5.2.1 The ordinary hours of work for Bakers/Pastrycooks and Apprentice Bakers/Pastrycooks shall be an average of 38 per week and shall be worked over five consecutive days unless otherwise agreed between the employee and employer. The limit of ordinary hours shall be as per 32.2 of Part 1 of this award.

5.2.2 Bakers/Pastrycooks and Apprentice Bakers/Pastrycooks who were working on a Sunday prior to the operation of this award shall continue to be paid at overtime rates for work performed on a Sunday.

5.3 Ordinary hours may be worked at any time on any day of the week. For all time worked within ordinary time the following penalties shall apply.

5.3.1 A 30% penalty will apply for a shift commencing between the hours of 9.00 p.m. to 5.00 a.m. Monday to Saturday. The 30% penalty will apply for the whole of the shift.

5.3.2 A 100% penalty will apply for a shift commencing between the hours of 9.00 p.m. Saturday and 5.00 a.m. Sunday.

5.3.3 A 50% penalty will apply to all ordinary hours worked between 5.00 a.m. and 9.00 p.m. Sunday.

5.3.4 Provided that the following provisions shall apply to persons employed as a Woolworths Employee Grade 4 (NT Baker):

5.3.4(a) Where work, not being overtime, finishes after midnight and at or before 8.00 a.m. the whole of that shift shall be a night shift, and the hours during such shift shall be ordinary hours.

5.3.4(b) When work, not being overtime, finishes at or after 6.00 p.m. and at or before Midnight the whole of that shift shall be an afternoon shift, and the hours during such shift shall be ordinary hours.

5.3.5 A shift penalty of 10% shall apply for all hours worked between midnight and 6.30 a.m. Monday to Saturday.

5.3.6 An employee engaged on a shift which does not continue for at least five consecutive working days shall be paid at the rate of double time and one half for each such shift.

5.3.7 Where a shift is worked so that part falls on one day, and part on another day the whole of such shift shall be deemed to fall, for the purposes of 5.3 of this Part and clause 35 - Public holidays of Part 1 on the day where the majority of hours are worked.

5.4 Rosters shall be advised to each employee and not changed on less than one week’s notice.
