18. ADDITIONAL PENALTIES FOR ORDINARY HOURS - PERMANENT EMPLOYEES

The following penalties will apply in addition to the award rate of pay. The stipulated penalties are to be paid on actual hours worked only.

18.1 Day workers

• Between 7.00 a.m. to 7.00 p.m. Saturday - 25%; and

• Public holidays - 150%.

18.2 Shift employees

• Between 7.00 p.m. to midnight Monday to Friday - 15%.

18.3 Casual employees

18.3.1 Instead of entitlements to sick leave, annual leave, public holidays or other forms of leave (excluding long service leave), a casual employee will be paid a loading of 22% for all hours worked, other than overtime.

18.3.2 In addition to the loading specified in 18.3.1, casuals will be entitled to the following penalties within the specified times:

• between 7.00 p.m. to 12.00 a.m. Monday to Friday - 15%; and
• public holidays (midnight to midnight) - 150%.

18.3.2(a) Additional penalties will be paid only on actual hours worked.

18.3.2(b) The casual loading and any additional penalties as prescribed in this clause are to be separately calculated on the ordinary time earnings rate.

18.4 Junior employees

Juniors will be entitled to such penalty rates as described in 18.1 and 18.2 to be paid upon their ordinary time rate as described in 13.5.1.
