PART 7 - TYPES OF LEAVE AND PUBLIC HOLIDAYS
24. ANNUAL LEAVE
24.1 Full-time employees
All full-time employees are entitled to 152 hours of annual leave at the end of each year of continuous employment.
24.2 Part-time employees
24.2.1 Annual leave for part-time employees shall be calculated on the basis of pro rata entitlements for full-time employees.
24.2.2 Where the number of hours actually worked varies during any anniversary year, (including where an employee transfers from full-time to part-time and vice versa) entitlements will be calculated upon the average number of ordinary hours worked during the anniversary year.
24.3 Taking annual leave

24.3.1 Annual leave will be taken by mutual agreement between the Company and the employee in varying periods of between one day and four weeks duration. Single day periods or part of a single day shall not exceeding a total of 10 days in any calendar year. One period must be of at least of two weeks duration, unless otherwise agreed between the employee and Company.

24.3.2 Annual leave must be granted and taken by the employee within two years of the date of entitlement. Under no circumstances must an employee forfeit their entitlement to such leave.
24.3.3 The Company will provide an employee with at least one month's notice (or less by mutual agreement) of the date from which their annual leave will be taken.
24.4 Leave loading
When proceeding on annual leave, in addition to their ordinary time earnings a permanent employee will receive a loading of 17-1/2%.
24.5 Payment for period of annual leave
24.5.1 For periods of leave of one week or more, an employee will receive payment for the period of absence including leave loading and any outstanding wages prior to commencing leave.
24.5.2 At the employee's request, the Company may:
24.5.3 Employees paid by electronic funds transfer will receive their wages on the normal pay day and unless by agreement with the employer it will be paid as per 24.5.1.
24.5.4 For periods of leave of less than one week, the employee will receive payment with their week’s wages on the normal pay day.
24.6 Effect of public holiday
Where a public holiday as outlined in clause 29 - Public holidays, to which the employee is entitled falls within a period of annual leave, the period of leave will be increased by one day in respect of that holiday.
24.7 Payment on termination
When the employment of an employee terminates, the employee will be paid any accrued annual leave not taken on the basis of:
24.7.1 payment for leave entitlements accrued from previous anniversary years based upon ordinary time earnings;
24.7.2 payment for pro rata leave entitlements accrued from the last anniversary date, calculated on the basis of 1/12th of the ordinary time earnings for that period, excluding 17-1/2% leave loading.
24.8 Leave taken in advance
Where an employee has been granted leave in advance of any entitlement and subsequently terminates their employment prior to accruing the appropriate leave, subject to State long service leave provisions, the Company may deduct moneys equivalent to such leave from any payment made to the employee on termination.
