26.1 Upon the death of a wife, husband, father, mother, stepfather, stepmother, parent-in-law, grandparent, child, stepchild or grandchild, brother or sister, a full-time or part-time employee shall be entitled to paid compassionate leave based upon ordinary time earnings (including shift loadings where applicable) which shall not exceed three shifts up to and including the funeral. Proof of such death shall be provided by the employee to the satisfaction of the Company, together with proof of attendance in the case of a funeral outside Australia.
26.2 Where the death of a relative detailed above, occurs outside of Australia and the employee does not attend the funeral, they shall be entitled to payment for one shift unless they can demonstrate to the Company that additional time up to a maximum of three shifts is justified.
26.3 There shall be no entitlement to leave under this clause where an employee is absent from work on another form of approved leave.
26.4 For the purpose of this clause the words wife or husband shall not include a wife or husband from whom the employee is separated but shall include a person who lives with the employee as a de facto wife or husband as the case may be.
