37. PROTECTIVE CLOTHING

37.1 Where the conditions of work are such that employees are unable to avoid their clothing becoming wet or dirty, the employer must reimburse the employee for the cost of purchasing suitable protective clothing provided that the employer need not make such reimbursement where suitable protective clothing is provided free of charge by the employer.

37.2 Where conditions of work are such that employees are unable to avoid their feet becoming wet, the employer must reimburse the employee for the cost of purchasing suitable protective footwear, provided that the employer need not make such reimbursement where suitable protective footwear is provided free of charge by the employer.

37.3 Any dispute in respect to the application of this clause may be referred to the Australian Industrial Relations Commission.
