The following procedure should be utilised to ensure that all employee grievances are dealt with appropriately.
43.1 In the first instance, the matter shall, wherever possible, be discussed by the concerned employee and their immediate supervisor with the joint intent of achieving a satisfactory outcome.
43.2 If the grievance or dispute is not resolved under 43.1, the employee or the employee’s representative may refer the matter to the next higher level of management for discussion. Such discussion should, if possible, take place within 48 hours of the request by the employee or the employee’s representative.
43.3 Should the issue still remain unresolved, an appropriate official from the union or other employee nominated representative and senior representative of the employer will then become involved. This may include union and employer representatives meeting as required to resolve the dispute.
43.4 Each stage of the grievance procedure should not be unreasonably delayed by any party.
43.5 Until the matter is finally determined, all work shall continue in accordance with the status quo which existed prior to the matter in dispute arising, or other agreed arrangements. No party shall be prejudiced as to the final settlement by the continuance or deferment of the work in accordance with this paragraph.
43.6 If the matter still remains unresolved following the above procedure, it may be referred by either party to the Australian Industrial Relations Commission for conciliation or arbitration.
43.7 An employee is entitled to be represented at each stage of the above procedure.
43.8 A union delegate or duly elected representative being a weekly employee of the employer, upon application in writing by the union must be granted up to 5 days leave with pay each calendar year, non cumulative, to attend courses conducted or approved by the union which are designed to promote dispute resolution and prevention.
43.9 A duly accredited representative of the union is permitted to post notices relating to union business in a place where it may conveniently and readily be seen by each employee employed.
