12.1 Employees covered by this award shall be employed in one of the following categories:
12.1.1 full-time employment; or
12.1.2 fixed term employment; or
12.1.3 casual employment; or
12.1.4 regular part-time employment.
12.2 At the time of engagement, the Company will inform each employee of the terms of his/her engagement.
12.3 Full-time employment
This involves employees engaged to work ordinary hours of 38 per week.
12.4 Fixed term employment
This involves a full-time or regular part-time employee who is formally engaged for a designated time period or defined work project.
12.5 Casual employment
12.5.1 A casual employee is one engaged and paid as such and whose employment may be terminated upon one hours notice.
12.5.2 At the time of engagement, such employees shall be notified in writing that the employment is on a casual basis.
12.5.3 A casual employee, for working ordinary time, shall be paid per hour for a period of not less than four hours for each day of engagement, 1/52nd of the appropriate rate specified in 16.1 divided by 38 for the work performed.
12.5.4 Casual employees also receive a loading of 25% in lieu of any entitlements to public holidays, annual, sick, family, bereavement and parental leave as prescribed in this award.
12.6 Regular part-time employment
12.6.1 A part-time employee is one who is employed to work less than the normal full-time hours of work prescribed in this award (i.e. less than the average of 38 hours per week).
12.6.2 A part-time employee works a regular and predictable pattern of hours and will:

12.6.2(a) be paid his/her appropriate salary specified in clause 16 - Salaries on a pro-rata basis;
12.6.2(b) receive pro rata entitlements to annual and sick leave depending on the hours worked;
12.6.2(c) be entitled to bereavement leave without loss of pay; and
12.6.2(d) be granted unpaid parental leave in accordance with this award.
12.6.3 At the time of engagement (before commencing part-time employment) the Company and the employee will agree in writing on:
12.6.3(a) the classification applying to the work to be performed; and
12.6.3(b) the regular pattern of hours to be worked - specifically the hours to be worked each day, the days to be worked each week and the actual starting and finishing times each day.
12.6.4 Any agreed variation to the contract of employment as specified in 12.6.3 shall be recorded in writing.
12.6.5 A copy of the terms of the contract or any variation to it shall be provided to the employee concerned.
12.6.6 A part-time employee who is required to work in excess of the hours agreed upon in accordance with 12.6.3 and 12.6.4 will be paid overtime in line with clause 24 - Overtime, for any hours worked on any day/shift in excess of the normal full-time hours for that classification. Additional hours on any day/shift that do not exceed the normal full-time hours for that classification will be paid at the ordinary time rate.
12.6.7 Where the part-time employees normal paid hours fall on a public holiday and work is not performed by the employee, he/she will not lose pay for the day. Where the employee works on the public holiday, he/she will be paid for the hours worked at the appropriate rate.
12.6.8 The term pro rata as used above means the ratio of contracted hours worked per week to the ordinary hours for a full-time employee (38).
12.7 Probation
12.7.1 All new employees, except for casuals, will for a period of up to three months after commencement, be engaged on a probationary basis for the purpose of determining their suitability for ongoing employment.
12.7.2 During this period such employees will be engaged on a daily basis and may be terminated on one days notice. However, they will be treated as a full-time or regular part-time employee (as the case may be) for all other purposes of this award.
