25. HOLIDAYS

25.1 An employee, other than a casual, shall be entitled to paid holidays on the following days:

25.2 Variation of public holidays

25.2.1 Where Christmas Day falls on a Saturday or a Sunday, the following Monday and Tuesday shall be observed as Christmas Day and Boxing Day respectively.

25.2.2 Where Boxing Day falls on a Saturday, the following Monday shall be observed as Boxing Day.

25.2.3 Where New Year’s Day, Australia Day or Anzac Day fall on a Saturday or Sunday, the following Monday shall be observed as the prescribed holiday.

25.2.4 Where alternative days are implemented pursuant to the subclause, the day on which the holiday actually falls (e.g. a Saturday) shall not be deemed a holiday for any purpose of this award.

25.3 Substitution of public holidays

25.3.1 The Company and its employees may agree to substitute another day for any prescribed in this clause. For this purpose, the consent of the majority of affected employees shall constitute agreement.

25.3.2 An agreement pursuant to 25.3.1 shall be recorded in writing and be available to every affected employee.

25.4 Additional holidays

Where the Victorian Government declares or prescribes a holiday in addition to those prescribed in this clause, such day shall be deemed to be a holiday for employees covered by this award.
