26. RECREATION LEAVE

26.1 Recreation leave - general

26.1.1 An employee to whom this clause applies will be credited with recreation leave at the rate of four weeks per annum at the employee’s prescribed hours of duty. Employees who resign or whose services are terminated will be paid accrued recreation leave credits including recreation leave loading. Recreation leave accrues fortnightly, in hours and minutes, based on the number of hours worked during the fortnight including recreation leave loading.

26.1.2 Higher duties allowance continues to be paid if the higher duties would have been performed but for the employee proceeding on recreation leave. Similarly, where an employee (other than a part-time employee) was in receipt of payments for duty (not in excess of prescribed weekly hours) for Saturday duty or Sunday duty, the employee will continue to be paid in accordance with clause 15 - Higher duties allowance (HDA), as if the duty had been performed but for the employee proceeding on recreation leave.

26.2 Deeming

Where an employee has accrued a recreation leave credit exceeding 40 days they will be required to take leave three months after the 40 days has been reached, until the excess leave has been utilised. Failure to apply for leave may result in the employee being deemed to be on leave unless alternative arrangements are agreed between the employee and their manager.

26.3 Seven day shift workers

26.3.1 In addition to the period of recreation leave prescribed in 26.1, shift workers will be entitled to an additional half a day paid leave for each rostered Sunday worked, up to a maximum of five days for each year.

26.3.2 A rostered overtime shift of three hours or more which either commences on a Saturday or concludes on a Monday and includes Sunday will also count for these purposes.

26.4 Annual leave loading (ALL)

26.4.1 Employees are entitled to an annual leave loading (ALL) subject to:

26.4.1(a) 17-1/2% of the total value of annual leave credits accrued for that year and calculated on the salary of the employee as at 1 January.

26.4.2 Salary for the purpose of calculating this entitlement includes any additional payments which the employee would have received if the employee had commenced on 1 January of the year in which the leave accrued.

26.4.3 Employees paid a salary less than the adult rate will receive annual leave loading according to the following table:
