9.1 Despite anything else in the award, the Company and an employee may agree to vary the hours and conditions of any employee to meet special circumstances in particular localities. Special conditions are to be in writing and signed off by the employee.
9.2 A copy of any agreement must be provided to the federal office of the relevant association/union within seven days of the implementation of, or alteration to, the special conditions.
9.3 If the parties fail to reach agreement, any party may apply to the Commission for an appropriate variation to the award.
