9.1 The Company and an employee, and where appropriate the union(s), may agree to vary an employee’s conditions under this award to meet special circumstances in particular localities.
9.2 The special conditions must be in writing and signed by the employee.
9.3 Conditions and wages applying to officers covered by this award who are based overseas shall be governed by a contract to be drawn up by the Company and signed by the officer at his or her home base prior to his or her departure to take up his or her duties overseas.
9.4 The provisions of clauses 19 - Hours of work (with respect to shift work provisions only), 20 - Overtime, 21- Sunday work and clauses 25.4 and 25.5 of clause 25 - Public holidays, will not apply to an employee who is temporarily engaged on duty away from his or her home base.
9.5 Where agreement cannot be reached as to the terms of any such conditions or contract a party to this award will have the right to discuss this matter with the Company. If agreement cannot be reached this matter will then be referred to the Commission for determination.
9.6 A copy of any agreement must be provided to the federal office of the relevant union within seven days of the implementation of, or alteration to, the special conditions or letters of posting.
