15. WAGES PER WEEK OF 38 HOURS

15.1 The minimum rates of pay for a week of 38 hours shall be:

15.1.2 In Western Australia:

15.2 The following classifications and gradings shall apply to Pharmacist-in-Charge and Pharmacist Manager positions.

15.2.1 Victoria

15.2.1(a) Pharmacists in Charge and Pharmacist Managers will be graded as follows:

15.2.1(a)(i) Grade 1 where supervised hours are up to and including 60 hours per week

15.2.1(a)(ii) Grade 2 where supervised hours are over 60 hours and up to and including 160 hours per week

15.2.1(a)(iii) Grade 3 where supervised hours are over 160 hours per week

15.2.1(b) For the purpose of this clause supervised hours shall mean hours of work (other than overtime) performed by employees employed as pharmacy assistants.

15.2.2 New South Wales

15.2.2(a) Pharmacist

15.2.2(a)(i) A Pharmacist, Pharmacist after first year of experience, or an Experienced Pharmacist works under the general direction of a Pharmacist-in-Charge, a Pharmacist Manager or a Pharmacist Proprietor.

15.2.2(a)(ii) Duties and responsibilities shall include, but shall not be limited to:

15.2.2(b) Pharmacist-in-Charge

15.2.2(b)(i) A Pharmacist-in-Charge is employed as the Pharmacist-in-Charge of a community pharmacy, either as the sole pharmacist employed in the business or as a Pharmacist-in-Charge of other employed pharmacists, and is responsible for both front-of-pharmacy and dispensary supervision. A Pharmacist-in-Charge is subject to the overall direction of a proprietor or manager.

15.2.2(b)(ii) Duties and responsibilities shall include, but shall not be limited to:

15.2.2(b)(iii) The proprietor or manager will retain responsibility for hiring and firing of staff, full business administration of profit and performance, and strategic planning.

15.2.2(c) Gradings of Pharmacist-in-Charge and Pharmacist Manager - Employment Periods in Excess of One Week

15.2.2(c)(i) Pharmacists In Charge or Pharmacist Managers will be graded as follows:

15.2.2(d) Gradings of Pharmacist-in-Charge and Pharmacist Manager - Employment Periods for Less than One Week

15.2.2(d)(i) Pharmacists In Charge or Pharmacist Managers will be graded according to the number of pharmacy assistants actually supervised for the period worked.

15.2.2(d)(ii) Equivalent full time supervised staff (EFTS) is calculated according to the following formula:

15.2.3 Queensland

15.2.3(a) Pharmacist Manager

15.2.3(a)(i) Grade 1 shall be a pharmacist registered under the Pharmacy Act 1976 who is in control of a pharmacy with up to five full-time employees (exclusive of pharmacists), and who is responsible for all necessary business appertaining thereto.

15.2.3(a)(ii) Grade 2 shall be a pharmacist registered under the Pharmacy Act 1976 who is in control of a pharmacy with between six and ten full-time employees (exclusive of pharmacists), and who is responsible for all necessary business appertaining thereto.

15.2.3(a)(iii) Grade 3 shall be a pharmacist registered under the Pharmacy Act 1976 who is in control of a pharmacy with in excess of ten full-time employees (exclusive of pharmacists), and who is responsible for all necessary business appertaining thereto.

15.2.3(b) Pharmacist-in-Charge

15.2.3(b)(i) Grade 1 shall be a pharmacist who is registered under the Pharmacy Act 1976 and who is employed in a pharmacy with up to five full-time employees (exclusive of pharmacists), where there are other pharmacists employed and who is appointed as the Pharmacist-in-Charge.

15.2.3(b)(ii) Grade 2 shall be a pharmacist who is registered under the Pharmacy Act 1976 and who is employed in a pharmacy with between six and ten full-time employees (exclusive of pharmacists), where there are other pharmacists employed and who is appointed as the Pharmacist-in-Charge.

15.2.3(b)(iii) Grade 3 shall be a pharmacist who is registered under the Pharmacy Act 1976 and who is employed in a pharmacy with in excess of ten full-time employees (exclusive of pharmacists), where there are other pharmacists employed and who is appointed as the Pharmacist-in-Charge.

15.2.3(c) For the purposes of the Queensland grading system the number of full time employees shall be determined by dividing the number of hours worked by all employees except pharmacists by the number of hours the pharmacy is open each week.

15.2.4 South Australia

15.2.4(a) Pharmacist-in-Charge means a person who is employed as the Pharmacist-in-Charge of a pharmacy, either as the sole pharmacist employed in the business or as a Pharmacist-in-Charge of other employed pharmacists, and is responsible for the pharmacy's operation. A Pharmacist-in-Charge is subject to the overall direction of a proprietor or pharmacy manager.

15.2.4(a)(i) Duties and responsibilities may include, but shall not be limited to:

15.2.4(a)(ii) The proprietor or pharmacy manager will retain responsibility for the employing and terminating of staff, full business administration and profit and performance, and strategic planning.

15.2.4(b) Pharmacist Managers and Pharmacists-in-Charge will be graded as follows:

15.2.4(b)(i) Grade 1: Pharmacist-in-Charge or Manager of a pharmacy where the equivalent full time supervised staff (E.F.T.S.) is up to 2.

15.2.4(b)(ii) Grade 2: Pharmacist-in-Charge or Manager of a pharmacy where E.F.T.S. is more than two (2) but less than four (4).

15.2.4(b)(iii) Grade 3: Pharmacist-in-Charge or Manager of a pharmacy where E.F.T.S. is more than four (4).

Note: E.F.T.S. (Equivalent Full-Time Supervised Staff) in relation to Pharmacy Manager and Pharmacist-in-Charge is calculated according to the following formula:

15.2.4(c) A Pharmacist works under the general direction of a Pharmacist-in-Charge, a Pharmacy manager or proprietor.

15.2.4(c)(i) Duties and responsibilities may include, but shall not be limited to:

15.2.5 Tasmania

15.2.5(a) A Pharmacist works under the general direction of a Pharmacist-in-Charge, a Pharmacist Manager or a proprietor.

15.2.5(a)(i) Duties and responsibilities shall include, but shall not be limited to:

15.2.5(b) A Pharmacist-in-Charge is employed as the Pharmacist-in-Charge of a retail pharmacy, either as the sole pharmacist employed in the business or as a Pharmacist-in-Charge of other employed pharmacists and is responsible for both front-of-pharmacy and dispensary supervision. A Pharmacist-in-Charge is subject to the overall direction of a proprietor or a Pharmacist Manager.

15.2.5(b)(i) Duties and responsibilities shall include, but are not limited to:

15.2.5(b)(ii) The proprietor or Pharmacist Manager will retain the responsibility for hiring and firing of staff, full business administration and profit, performance and strategic planning.

15.2.5(c) Pharmacists in Charge and Pharmacist Managers will be graded as follows:

15.2.5(c)(i) Grade 1 - in charge of or manages a pharmacy where the equivalent full-time staff (EFTS) is less than 2.

15.2.5(c)(ii) Grade 2 - in charge of or manages a pharmacy where the EFTS is 2 (or greater) but less than 4.

15.2.5(c)(iii) Grade 3 - in charge of or manages a pharmacy where the EFTS is 4 or more.

15.2.5(c)(iv) The number of Equivalent Full-Time Staff (EFTS) is calculated as follows:

15.2.6 Australian Capital Territory

15.2.6(a) A Pharmacist works under the general direction of a Pharmacist-in- charge, a Pharmacist Manager or a pharmacist proprietor.

15.2.6(a)(i) Duties and responsibilities shall include, but not be limited to:

15.2.6(b) Pharmacist-in-Charge

A Pharmacist-in-Charge is employed as the Pharmacist-in-Charge of a community pharmacy, either as the sole pharmacist employed in the business or as the Pharmacist-in-Charge of other employed pharmacists, and is responsible for both front of pharmacy and dispensary supervision. A Pharmacist-in-Charge is subject to the overall direction of a proprietor or manager.

15.2.6(c)(iii) Grade 3 where supervised hours are over 160 hours per week

15.2.6(d) For the purpose of this clause supervised hours shall mean hours of work (other than overtime) performed by employees employed as pharmacy assistants.

15.2.7 Western Australia

15.2.7(a) Pharmacist-in-Charge Grade 1 means a Pharmacist-in-Charge of more than 10 but not more than 20 other employees.

15.2.7(b) Pharmacist-in-Charge Grade 2 means a Pharmacist-in-Charge of more than 20 other employees.

15.2.7(c) Pharmacist

15.2.7(c)(i) The registered pharmacist commencement level. A pharmacist is professionally responsible for the dispensing of prescriptions in accordance with the Pharmacy Act.

15.2.7(c)(ii) Duties and responsibilities shall include, but shall not be limited to:

15.2.7(c)(iii) A pharmacist may in the course of employment be placed in charge of not more than ten other employees and be required to perform such other tasks in a pharmacy as are incidental to being in charge of others, but who shall not be required to perform substantial management tasks.

15.2.7(d) Pharmacist Manager

15.2.7(d)(i) A Pharmacist Manager is employed as the pharmacist in control of the business. Pharmacy Managers are totally responsible to the proprietor for all aspects of the business, including rostering of staff, hiring and firing of staff, full business administration and profit and performance, and strategic planning.

15.2.7(d)(ii) Pharmacist Managers will be graded as follows:

15.2.7(d)(ii)(1) Grade 1: Manages a small pharmacy where the equivalent full-time supervised staff (EFTS) is two or less.

15.2.7(d)(ii)(2) Grade 2: Manages a medium pharmacy where the EFTS is more than two but less than five.

15.2.7(d)(ii)(3) Grade 3: Manages a large pharmacy where the EFTS is five or more.

15.2.7(d)(iii) Equivalent Full-Time Supervised Staff is calculated according to the following formula:

15.3 Wages for students and trainees

15.3.1 Pharmacy trainees

The minimum rate of pay for a week of 38 hours shall be:

First half of traineeship – $615.90
Second half of traineeship – $677.30

15.3.2 Pharmacy students

The minimum rates of pay for a week of 38 hours shall be:

15.3.2A 500 hour student (Western Australia only)

15.3.2A.1 500 Hour Student is a person who is undertaking an accredited course of study leading to a degree of Bachelor of Pharmacy and who enters into an Articles of Traineeship with the Pharmaceutical Council of Western Australia to complete the first 500 hours of their pre-registration training in a pharmacy prior to satisfying the examination requirements for the degree of Bachelor of Pharmacy.

15.3.2A.2 The minimum rates of pay for a week of 38 hours per week for a 500 Hour Student undertaking their first 500 hours of pre-registration training shall only be:

15.3.2A.3 The full federal adult minimum wage for full time adult employees does not apply to a 500 Hour Student.

15.3.2A.4 This clause 15.3.2A does not apply to Pharmacy Students other than in connection with the first 500 hours of pre-registration training.

15.3.3 Calculation of rates

The rates of pay applying to students and trainees shall be calculated in multiples of ten cents, with any five cents or more being adjusted to the next highest ten cent multiple.

15.4 Higher Duties Payment

Where an employee who is not employed as a Pharmacist Manager or Pharmacist-in-Charge is called upon to replace the Proprietor, Manager or Pharmacist-in-Charge for a minimum of two hours they shall be paid at the appropriate Pharmacist-in-Charge rate in accordance with this award for all such hours worked.

15.5 Arbitrated safety net adjustment

15.5 Payment of wages

Payment of wages shall be made weekly, fortnightly or monthly according to the contract of employment, or the work cycle in accordance with 21.1, or as otherwise agreed.

15.6 Part-time Employees - Tasmania Only

15.6.1 By agreement (in writing) between the employer and an employee, a part-time employee in Tasmania may be paid a loading of 20% in lieu of pro-rata entitlements to annual leave, personal leave and holidays with pay.

15.6.2 Such an employee will be entitled, on application, to leave without pay to a maximum of four weeks for each year of employment to be taken at a time mutually agreed between the employer and employee.

15.8 Savings Provision

Nothing in this award shall be deemed to be construed to:

15.7.1 reduce the salary or allowances; or

15.7.2 alter unfavourably the terms and conditions of employment applying to any employee immediately prior to the date of operation of this variation.

15.8 Transitional Wage Rates for Victoria-Application of Common Rule Award

15.8.1 This award contains the following transitional rates of pay and allowances for employers in the state of Victoria who were previously not bound by this award, but are now subject to the award by virtue of the award having been declared a common rule under s.141 of the Workplace Relations Act 1996.

15.8.2 These rates of pay shall not apply after the beginning of the first full pay period on or after 1 August 2005.

15.8.3 The minimum rates of pay for a week of 38 hours shall be:

15.9 Garment allowance

Where an employee is required to wear a uniform the employer shall arrange for its cleaning or shall pay the employee an allowance of $1.62 per day.

15.10 Vehicle allowance

Where an employee is required to use his or her own vehicle in the performance of their duties an allowance shall be paid as follows:

15.11 Meal Allowance

A meal allowance of $10.66 shall be paid where a meal break is required to be taken between a period of ordinary time and overtime or during a period of overtime.
