24.1 An employee shall be paid overtime for all work:
24.1.1 in excess of twelve hours per day or an average of 38 hours per week in accordance with clause 21 - Hours of Work;
24.1.2 performed outside rostered hours.
24.2 Overtime shall be paid for as follows:
24.2.1 Victoria:
24.2.1(a) Monday to Saturday inclusive.
24.2.1(b) At time and a half for the first four hours and double time thereafter.
24.2.1(c) Each day’s overtime shall stand alone.
24.2.2 New South Wales
24.2.2(a) Monday to Saturday inclusive
24.2.2(b) At time and a half for the first two hours and double time thereafter.
24.2.2(c) In computing overtime, less than 30 minutes shall be reckoned as 30 minutes and more than 30 minutes shall be reckoned as an hour.
24.2.2(d) Provided that where an employee is required to work after closing time to attend to customers then in the pharmacy only time actually worked shall count.
24.2.3 Queensland
24.2.3(a) Monday to Saturday inclusive.
24.2.3(b) At time and a half for the first three hours and double time thereafter.
24.2.3(c) Each day’s overtime shall stand alone.
24.2.3(d) Overtime worked on a Saturday or Sunday shall be paid with a minimum of two hours.
24.2.4 South Australia
24.2.4(a) Monday to Saturday inclusive.
24.2.4(b) At time and a half for the first three hours and double time thereafter.
24.2.4(c) Each day’s overtime shall stand alone.
24.2.5 Tasmania
24.2.5(a) Monday to Saturday inclusive.
24.2.5(b) At time and a half for the first three hours and double time thereafter.
24.2.5(c) Public Holidays. At double time for all hours worked.
24.2.5(d) An employee who works past the close of business to close the pharmacy, shall be paid at the same rate at the time fixed for ceasing work for fifteen minute intervals up to a maximum of 30 minutes at that rate. Thereafter normal overtime provisions shall apply.
24.2.6 ACT
24.2.6(a) Monday to Saturday inclusive.
24.2.6(b) At time and a half for the first two hours and double time thereafter.
24.2.6(c) Each day’s overtime to stand alone.
24.2.6(d) Any portion of an hour less than 30 minutes shall be reckoned as 30 minutes, and any portion of an hour over 30 minutes shall be reckoned as one hour, except where an employee is required to work after the closing time to attend to customers in the pharmacy, or in connection with the closing of the pharmacy, including checking of cash received, when the time actually worked shall count.
24.2.7 Western Australia
24.2.7(a) Monday to Saturday inclusive.
24.2.7(b) At the rate of time and a half for the first two hours and double time thereafter.
24.3 All overtime on Sunday shall be paid at the rate of double time.
24.4 Where an employee is working overtime in ordinary hours which attract a penalty rate then the higher of the overtime or penalty rate applies to all such hours.
24.5 Time off in lieu of payment for overtime
24.5.1 An employee may elect, with the consent of the employer, to take time off in lieu of payment for overtime at a time or times agreed with the employer.
24.5.2 Overtime taken as time off during ordinary time hours shall be taken at the overtime rate.
24.5.3 An employer shall, if requested by an employee, provide payment, at the rate provided for the payment of overtime in the award, for any overtime worked where such time has not been taken within four weeks of accrual.
