or such other day as is generally observed in the locality as a substitute for any of the said days respectively or as published in the relevant State Government Gazette.

20.1.1 When Christmas Day is a Saturday or a Sunday, a holiday in lieu of that day shall be observed on 27 December. In relation to full time workers whose ordinary hours are regularly rostered to be worked on a Saturday or Sunday, when substitution occurs because Christmas Day falls on a weekend, ordinary hours worked on 25 December will attract an additional loading of half a normal day’s wage for a full day’s work in addition to the Saturday/Sunday rate and the employee will also be entitled to the benefits of the substituted public holiday.

20.1.2 When Boxing Day is a Saturday or a Sunday, a holiday in lieu of that day shall be observed on 28 December.

20.1.3 When New Year’s Day or Australia Day is a Saturday or Sunday, a holiday in lieu of that day shall be observed on the next Monday.

20.2 Payment for work performed on a Public Holiday described in 20.1 will be at the rate of double time with a minimum of four hours payment. Provided that, notwithstanding anything contained elsewhere within this award, at the instigation of the employee and with the agreement of the employer the four hour minimum may be reduced to a two hour minimum payment at the rate of double time.

20.3 When an employee is absent from their employment only on one working day or part of a day before or after a holiday, except on account of illness or other legitimate reason, they will not suffer loss of payment for more than one day of the holidays.

20.4 Where in a State or Territory or locality within a State or Territory an additional public holiday (other than Easter Sunday) is proclaimed or gazetted by the authority of the Commonwealth Government or of a State or Territory Government and such proclaimed or gazetted holiday is to be observed generally by persons throughout the State or Territory or a locality thereof, other than by those covered by Federal awards, or when such a proclaimed or gazetted day is, by any required judicial or administration order, to be so observed, then such day will be deemed to be a holiday for the purposes of this award, for employees covered by this award who are employed in the State, Territory or locality in respect of which the holiday has been proclaimed or ordered as required. (The insertion of this provision will not itself prejudice the right of the union to make application for variation of this award in respect to Easter Sunday).
