23. HOURS
23.1 Weekly hours
The ordinary hours of work of employees must not exceed 38 hours each week, Monday to Sunday inclusive and save for the meal times prescribed, all time between the actual commencing time and actual ceasing time on any day will count and be paid for as time worked.
23.2 Commencing times
23.2.1 The commencing time of the ordinary hours of work Monday to Saturday is 7.00 a.m. and 8.00 a.m. on Sunday, except in newsagencies and builders’ supply merchants, grocery and hardware shops or departments.
23.2.2 In newsagencies the commencing time of ordinary hours of work Monday to Sunday will be 5.00 a.m. For employees engaged in the sale of building materials and supplies, hardware or groceries the commencing times of the ordinary hours of work Monday to Saturday will be 6.00 a.m. and 8.00 a.m. on Sunday.
23.3 Ceasing times in retail shops
The times for cessation of the ordinary hours of work by employees in retail shops will be:
23.3.1 Monday to Thursday 6.00 p.m., Friday 9.00 p.m., Saturday 6.00 p.m. and 5.00 p.m. on Sunday.
23.3.2 In the case of newsagents, Monday to Thursday, both days inclusive, 6.30 p.m., Friday 9.00 p.m., Saturday 6.00 p.m. and Sunday 5.00 p.m.
23.4 Span of hours for warehouse and wholesale employees
Despite the above provisions of this clause warehouse and wholesale employees may be rostered for ordinary duty between 7.00 a.m. and 6.00 p.m. Monday to Friday inclusive.
23.5 Special provision for substituted late shopping night
23.5.1 During any week in which the normal late shopping night of Friday falls on a public holiday the employer may specify another late shopping night on either Wednesday or Thursday night and that day will be considered to be a Friday and Friday will be considered to be the specified day for all purposes of this award, except as to clause 34 - Public holidays, of this award.
23.5.2 However where a public holiday based on clause 34 - Public holidays, falls on a Friday and Friday is considered to be another day, employees will not receive less time off than they might otherwise have received had the substitution not been made.
23.5.3 Employees must be notified of the selected late night at least two weeks prior to the substituted late night for this clause to have effect.
23.6 Make up time
Notwithstanding provisions elsewhere in the award, the employer and the majority of employees at an enterprise may agree to establish a system of make up time provided that:
23.6.1 An employee may elect, with the consent of the employer, to work make up time under which the employee takes time off during ordinary hours, and works an equivalent period, during the spread of ordinary hours provided in the award.
23.6.2 Clause 23.6 is subject to the employer informing each union which is both party to the award and which has members employed at the particular enterprise of its intention to introduce an enterprise system of RDO flexibility, and providing a reasonable opportunity for the union(s) to participate in negotiations.
23.6.3 Once a decision has been taken to introduce an enterprise system of make up time, in accordance with this clause, its terms must be set out in the time and wages records.
23.6.4 An employer shall record make up time arrangements in the time and wages book each time this provision is used.
