26.1 A full-time employee shall be entitled, without loss of pay, to public holidays as follows:
26.2 In addition to the public holidays observed above, an employee shall be entitled to one additional public holiday, where it is gazetted by Federal or State authority, to be observed in that State, Territory or locality.
26.3 For the purposes of this award:
26.3.1 Where Christmas Day falls on a Saturday or on a Sunday, the following Monday and Tuesday shall be observed as the public holiday for Christmas Day and Boxing Day respectively.
26.3.2 Where Boxing Day falls on a Saturday, the following Monday shall be observed as the public holiday for Boxing Day.
26.3.3 Where New Year’s Day falls on a Saturday or on a Sunday, the following Monday shall be observed as the public holiday for New Year’s Day;
and the said Saturday and/or Sunday shall be deemed not to be holidays.
26.4 By agreement between the Employer and the majority of employees at a laboratory, other days may be substituted for any of the said holidays.
26.5 Specific task/period employees shall be entitled to public holidays which fall during the course of their employment on the same basis as full-time employees.
26.6 Part-time employees shall receive the same benefit on a pro rata basis to average ordinary hours worked. For the purposes of this calculation the average ordinary hours worked shall be the average over the previous six months, or the average over the duration of employment if this is a lesser period.
26.7 Except for casuals, employees who work on a public holiday shall be paid at double time and a half, and this rate shall continue until the employee is relieved from duty.
26.8 Casual employees who work on a public holiday shall be paid at 2.7 times the ordinary-time rate for full-time employees.
26.9 Rostered days off shall not coincide with a public holiday fixed in accordance with this clause.
