25B. MARITIME SECURITY IDENTIFICATION CARD (MSIC)

25B.1 Where an employer directs an employee to obtain a Maritime Security Identification Card (MSIC), the cost to the employee of such a card shall be reimbursed to the employee upon production of proof of expenditure.
25B.2 The employer can direct an employee to obtain the MSIC from a specific provider and the employee shall comply with such a direction in a timely manner.
25B.3 The employer shall only be responsible for the reimbursement of the direct and immediate costs associated with the MSIC. The employer shall not be responsible for the reimbursement of any additional costs.
25B.4 The employer will not be responsible for the reimbursement of the cost of any replacement card required to be obtained by the employee because the initial card was lost, misplaced, or damaged as a result of an employee’s negligence.
25B.5 If an employee terminates their employment during a probationary period not exceeding three months, the employer may withhold from any outstanding monies due, including accrued leave entitlements, an amount no greater than the costs reimbursed by the employer pursuant to clause 25B.1.
25B.6 If an employee terminates their employment with an employer within 12 months of the date of issue of an MSIC, without giving the period of notice required by clause 13.2 of this award, the employer may withhold from any outstanding monies due, including accrued leave entitlements, an amount no greater than the costs reimbursed by the employer pursuant to clause 25B.1.
25B.7 If the employer meets the costs of the provision of the MSIC directly then the obligation to reimburse an employee prescribed by this clause does not arise.
25B.8 If the employer meets the costs of the MSIC directly then the provisions of clause 25B.5 and 25B.6 will apply as if the employer had reimbursed the costs referred to.
25B.9 Should any issue arise concerning the operation of this clause it shall be dealt with by way of clause 11 – Settlement of Disputes.
