1 - TITLE
This award shall be known as the Transport Workers’ (Refuse) (Roping in No. 1) Award 1998.
2 - PARTIES BOUND
This award shall be binding upon:
(a) The Transport Workers’ Union of Australia, its officers and members; and
(b) The employers listed in Schedule ‘A’ hereof.
3 - APPLICATION
(1) Subject to that which is otherwise provided in this award, the provisions of the Transport Workers’ (Refuse) Award 1988 (other than the clauses referred to in subclauses (2) - (5)) as varied from time to time, shall apply.
(2) The following clauses of the Transport Workers (Refuse) Award 1988 - Part I will not apply:
(a) Clause 9B - Commitment
(b) Clause 9C - Award modernisation
(c) Clause 9D - Enterprise flexibility discussions
(d) Clause 13 - Juniors
(e) Clause 15 - Time books
(f) Paragraph 22A(d)(xii) - Parental leave, part-time work and inconsistent award provisions
(g) Clause 32 - Right of entry
(h) Clause 33 - Notice board
(i) Clause 38 - Training
(j) Clause 39 - Trade union training
(3) The following clauses of the Transport Workers (Refuse) Award 1988 - Part II will not apply:
(a) Clause 3 - Heavy articles
(4) The following clauses of the Transport Workers (Refuse) Award 1988 - Part III will not apply:
(a) Clause 2 - Heavy articles
(5) The following clauses of the Transport Workers (Refuse) Award 1988 - Part IV will not apply:
(a) Clause 3 - Heavy articles
(6) Leave is reserved for any party to this award to seek to have apply any of the clauses of the Transport Workers (Refuse) Award 1988 referred to in subclauses (2)-(5), when the Transport Workers (Refuse) Award 1988 is varied in accordance with sub-items 49(1) or 51(2) of Schedule 5 of the Workplace Relations and Other Legislation Amendment Act 1996.
4 - OPERATION
This award shall come into force from the beginning of the first full pay period commencing on or after 5 May 1998 and shall remain in force for six months.
