25.1 Definition - inclement weather
Inclement weather shall mean the existence of rain or abnormal climatic conditions (whether they be those of hail, snow, cold, high wind, severe dust storm, extreme of high temperature or any combination of these) by virtue of which it is either not reasonable or not safe for employees exposed to continue working whilst the inclement weather continues.
25.2 Entitlement to payment
25.2.1 An employee shall be entitled to payment by his/her employer for ordinary time lost through inclement weather for up to 32 hours in every period of four weeks.
For the purpose of this subclause the following conditions shall apply:
25.2.1(a) The number of hours credited to any employee under this clause shall be reduced by the number of hours for which payment is made in respect of lost time through inclement weather.
25.2.1(b) Payment under this clause shall be weekly.
25.3 Transfers
Employees may be transferred from one location on a site where it is unreasonable to work due to inclement weather, to work at another location on the same site, or another site, which is not affected by inclement weather subject that the employees may be transferred from one site to another site and the employer provides, where necessary, transport.
25.4 Remaining on site
25.4.1 Where because of wet weather, the employees are prevented from working:
25.4.1(a) for more than an accumulated total of four hours or ordinary time in any one day; or
25.4.1(b) after the meal break, as provided in 20.4.2, for more than an accumulated total of 50% of the normal afternoon work time; or
25.4.1(c) during the final two hours of normal work day for more than an accumulated total of one hour;
the employer shall not be entitled to require the employees to remain on site beyond the expiration of any of the above circumstances.
25.4.2 Provided that where, by agreement between the employer and/or his/her representative and the employees’ representative the employee remain on site beyond the periods specified above, any such additional wet time shall be paid for but shall not be debited against the employee’s hours.
25.4.3 Provided further that wet time occurring during overtime shall not be taken into account for the purposes of this subclause.
