AT828612 - Transport Workers’ (Virgin Tech) Award 2003 [Transitional]
39.1 Virgin Tech, who requires an employee to fly in an aircraft, will indemnify/insure the employee against death or totally incapacitating injury which may arise from the use of the aircraft for not less than $45,000.
39.2 Such indemnity/insurance need not be provided by Virgin Tech where the employees will receive a benefit of not less than $45,000 in the event of death or totally incapacitating injury by way of insurance taken out by the aircraft or charter operators or by way of Virgin Tech-sponsored superannuation scheme.
39.3 No employee will be compelled to work on an aircraft during a bomb scare, or hijack incident, provided however an employee who volunteers to work during a bomb scare or hijack incident will be indemnified/insured by Virgin Tech to cover injury, death or disablement to a minimum of $150,000.
39.4 The amount payable under this clause is additional to any amount an employee or the employee’s next of kin may be entitled to receive under any Worker’s Compensation Act or similar provision.
