VILLAGE ROADSHOW THEME PARKS - MEAA ENTERTAINERS AGREEMENT 2010
Live performance industry
SENIOR DEPUTY PRESIDENT HARRISON
SYDNEY, 19 JULY 2010
Application for approval of the The Village Roadshow Theme Parks - MEAA Entertainers Agreement 2010.
An application has been made for approval of an enterprise agreement known as the Village Roadshow Theme Parks - MEAA Entertainers Agreement 2010 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). The Agreement is a single-enterprise agreement.
I am satisfied that each of the requirements of ss186, 187 and 188 as are relevant to this application for approval have been met. In this respect I note that the Warner Bros Movie World - M.E.A.A. Entertainers Award 2001 1 is the relevant award for the application of the better off overall test. This is an enterprise award and I note it contains a multi-hiring clause and a banking of hours in similar terms as this enterprise agreement. For this reason I accepted the submissions of both the employer and the Media, Entertainment and Arts Alliance (MEAA) the test was satisfied.
Written undertakings concerning clauses 5.1.6 and 8.2 have been provided by the employer and they are taken to be terms of the Agreement. A copy of the undertakings is attached in Annexure A.
The MEAA, being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. As required by s.201(2) I note that the Agreement covers the organisation.
The Agreement is approved. In accordance with s.54(1) it will operate from 26 July 2010. The nominal expiry date of the Agreement is 1 June 2012.
