4 yearly review of modern awards—Public Holidays

Part-day public holidays.
[1] On 15 June 2018 and 18 July 2018, the public holidays Full Bench issued statements 1 concerning part-day public holiday provisions that are contained in most modern awards. The matter was listed for conference before Commissioner Hampton on 10 August 2018 and a Report2 to the Full Bench was subsequently issued by Commissioner Hampton.
[2] In a decision published on 7 November 2018 3 the Public Holidays Full Bench considered the Report and concluded that given the 4 yearly review it was ‘not presently necessary’4 to make provision for the further review of the part-day public holiday schedules in modern awards. In doing so, the Full Bench earlier noted that ‘if there is to be any award by award consideration of whether the Schedules are required in their present form, this will take some time and will require that all of the other terms of the modern awards that bear upon this issue have been finalised. This finalisation will not take place until the (other) terms of the modern awards are resolved as part of the 4 yearly review.’5
[3] In a decision 6 issued on 17 December 2019 the part-day public holidays schedules in 113 modern awards was varied pursuant to s.160. The list of awards containing part-day public holidays schedules are set out at Appendix A. There are 5 different versions of the part-day public holiday schedule and these are set out at Appendix B.
[4] I have decided to transfer the further review of the part-day public holidays schedules from the Public Holidays Full Bench (AM2014/301) to the Finalisation of Exposure Drafts Full Bench (AM2019/17).
[5] This matter will be the subject of a conference before Commissioner Hampton in February 2020. A notice of listing will be published in due course.

Version 1:
‘This schedule operates in conjunction with award provisions dealing with public holidays.
(a) All employees will have the right to refuse to work on the part-day public holiday if the request to work is not reasonable or the refusal is reasonable as provided for in the NES.
(b) Where a part-time or full-time employee is usually rostered to work ordinary hours on the declared or prescribed part-day public holiday between 7.00 pm and midnight but as a result of exercising their right under the NES does not work, they will be paid their ordinary rate of pay for such hours not worked.
(c) Where a part-time or full-time employee is usually rostered to work ordinary hours
on the declared or prescribed part-day public holiday between 7.00 pm and midnight but as a result of being on annual leave does not work, they will be taken not to be on annual leave during the hours of the declared or prescribed part-day public holiday between those hours of 7.00pm and midnight that they would have usually been rostered to work and will be paid their ordinary rate of pay for such hours.
(d) Where a part-time or full-time employee is usually rostered to work ordinary hours
on the declared or prescribed part-day public holiday between 7.00 pm and midnight, but as a result of having a rostered day off (RDO) provided under this award, does not work, the employee will be taken to be on a public holiday for such hours and paid their ordinary rate of pay for those hours.
(e) Where an employee works any hours
on the declared or prescribed part-day public holiday
between 7.00 pm and midnight they will be entitled to the appropriate public holiday penalty rate (if any) in this award for those hours worked.
(f) An employee not rostered to work
on the declared or prescribed part-day public holiday
between 7.00 pm and midnight, other than an employee who has exercised their right in accordance with clause F.1(a), will not be entitled to another day off, another day’s pay or another day of annual leave as a result of the part-day public holiday.
(g) Nothing in this schedule affects the right of an employee and employer to agree to substitute public holidays.
X.2 An employer and employee may agree to substitute another part-day for a part-day that would otherwise be a part-day public holiday under the NES.
This schedule is not intended to detract from or supplement the NES.’

(a) All employees will have the right to refuse to work on the part-day public holiday if the request to work is not reasonable or the refusal is reasonable as provided for in the NES.
(b) Where a part-time or full-time employee is usually rostered to work ordinary hours
on the declared or prescribed part-day public holiday between 7.00 pm and midnight but as a result of exercising their right under the NES does not work, they will be paid their ordinary rate of pay for such hours not worked.
(c) Where a part-time or full-time employee is usually rostered to work ordinary hours
on the declared or prescribed part-day public holiday between 7.00 pm and midnight but as a result of being on annual leave does not work, they will be taken not to be on annual leave during the hours of the declared or prescribed part-day public holiday between those hours of 7.00 pm and midnight that they would have usually been rostered to work and will be paid their ordinary rate of pay for such hours.

(e) Excluding annualised salaried employees to whom clause F.1(f) applies, where an employee works any hours
on the declared or prescribed part-day public holiday
between 7.00 pm and midnight they will be entitled to the appropriate public holiday penalty rate (if any) in this award for those hours worked.
(f) Where an employee is paid an annualised salary under the provisions of this award and is entitled under this award to time off in lieu or additional annual leave for work on a public holiday, they will be entitled to time off in lieu or pro-rata annual leave equivalent to the time worked
on the declared or prescribed part-day public holiday between 7.00 pm and midnight.
(g) An employee not rostered to work
on the declared or prescribed part-day public holiday between 7.00 pm and midnight, other than an employee who has exercised their right in accordance with clause F.1(a), will not be entitled to another day off, another day’s pay or another day of annual leave as a result of the part-day public holiday.
X.2 An employer and employee may agree to substitute another part-day for a part-day that would otherwise be a part-day public holiday under the NES.

(g) An employee not rostered to work
on the declared or prescribed part-day public holiday between 7.00 pm and midnight, other than an employee who has exercised their right in accordance with clause F.1(a), will not be entitled to another day off, another day’s pay or another day of annual leave as a result of the part-day public holiday.

(c) Where a part-time or full-time employee is usually rostered to work ordinary hours on the declared or prescribed part-day public holiday between 7.00 pm and midnight but as a result of being on annual leave does not work, they will be taken not to be on annual leave during the hours of the declared or prescribed part-day public holiday between those hours of 7.00 pm and midnight that they would have usually been rostered to work and will be paid their ordinary rate of pay for such hours.
(d) Where a part-time or full-time employee is usually rostered to work ordinary hours
on the declared or prescribed part-day public holiday between 7.00 pm and midnight, but as a result of having a rostered day off (RDO) provided under this award, does not work, the employee will be taken to be on a public holiday for such hours and paid their ordinary rate of pay for those hours.
(e) Where an employee works any hours
on the declared or prescribed part-day public holiday between 7.00 pm and midnight they will be entitled to the appropriate public holiday penalty rate (if any) in this award for those hours worked.
(f) An employee whose ordinary pattern of work involves rostered shifts which include the hours
on the declared or prescribed part-day public holiday
between 7.00 pm and midnight but who is not rostered to work on the declared or prescribed part-day public holiday between 7.00 pm and midnight on 24 December 2017 or 31 December 2017, and who is entitled to the benefit of clause 36.3 or 36.4 of this award, shall be entitled to the benefit of those clauses on a pro-rata basis, by reference to the number of ordinary hours falling
on the declared or prescribed part-day public holiday between 7.00 pm and midnight. An employee whose ordinary pattern of work DOES NOT include rostered shifts which include the hours
on the declared or prescribed part-day public holiday between 7.00 pm and midnight shall not be entitled to the benefit of clauses 36.3 and 36.4 of this award.
X.2 An employer and employee may agree to substitute another part-day for a part-day that would otherwise be a part-day public holiday under the NES.’
