4 yearly review of modern awards–finalisation of exposure drafts–Pastoral Award 2010.

[1] This Statement deals with the process for finalising the exposure draft and variation determination for the Pastoral Award 2010 (the Pastoral Award).

[2] The exposure draft and a draft variation determination for the Pastoral Award were published on 14 October 2019.

[3] In a decision issued on 24 December 2019, 1 we finalised a number of outstanding technical and drafting matters in the Pastoral Award (see [322] to [362]). We also noted that a conference would be listed to discuss further outstanding matters. On 13 January 2020, the National Farmers Federation (NFF) made a submission2 confirming it’s agreement with the AWU’s proposals for resolving the remaining 3 issues. The conference was therefore unnecessary and did not proceed.

[4] In a decision issued on 14 February 2020 3 we finalised the tranche 2 awards and said:

[14] A different process will apply in respect of the Pastoral Industry Award 2010. On 29 January 2020 another Full Bench issued a decision resolving an ambiguity in relation to when an employee working overtime is entitled to a second meal break. The variation determination giving effect to that decision has not yet been settled. To avoid any confusion we propose to wait until that variation determination has been made before publishing a revised draft variation determination in respect of this award. We will publish a statement setting out the process for commenting on that revised draft variation determination, in due course.

[5] The other Full Bench issued a decision on 20 March 2020 4 finalising the ambiguity issue. A final variation determination was issued on the same day.

[6] The exposure draft has been updated to include the following:

•  The new Schedule X ([2020] FWCFB 1837)

•  The new annualised wage arrangements provision ([2019] FWCFB 8583)

•  Amendments arising from our decisions of 24 December 2019 ([2019] FWCFB 8569) and 14 February 2020 ([2020] FWCFB 690)

•  Variations arising from the Full Bench decision finalising the meal breaks issue ([2020] FWCFB 384)

[7] The revised exposure draft and draft variation determination will be published with this statement. Submissions are to be filed by no later than 4:00pm on Tuesday 30 June 2020. All submissions must be sent electronically to amod@fwc.gov.au.  Any outstanding issues will be resolved on the papers.
