4 yearly review of modern awards – finalisation of Exposure Drafts and variation determinations – Tranche 1 – Mining Industry Award 2010.

Introduction and background

[1] This decision deals with the finalisation of the variation determination for the Mining Industry Award 2010 (the Mining Award), as part of the 4 yearly review of modern awards (the Review).

[2] The Mining Award was a Tranche 1 award for the purpose of the Review.

[3] In a decision of 2 September 2019 1 (September 2019 Decision) we outlined the process for finalising the Exposure Drafts produced during the Review and the consequent variation of each modern award. We expressed the provisional view that the variation of the modern awards in Tranche 1 in accordance with the draft variation determinations set out in Attachment D to the September 2019 Decision, is necessary to meet the modern awards objective.2

[4] Interested parties were directed to comment on the draft variation determinations.

[5] A hearing was held on 11 October 2019 (October 2019 Hearing) in relation to issues raised in respect of the Tranche 1 awards. A transcript of the hearing is available on the Commission’s website. 3

[6] A decision was issued on 24 October 2019 4 (October 2019 Decision) which that final variation determinations would be issued on 25 November 2019 for 31 awards in Tranche 1, excluding the Mining Award.

[7] The October 2019 Decision confirmed that amendments would be made to the Exposure Draft and variation determination for the Mining Award to address an issue relating to the definition of ‘casual ordinary hourly rate’ and ‘ordinary hourly rate’ at clause 2. 5 As the issue of casual overtime rates was contested we decided that a variation determination in relation to the Mining Award would not be issued at that time and that a conference of interested parties would be.6

[8] At the conference held on 26 November 2019 it was agreed that the casual overtime rates issue had been determined by the Full Bench in a decision of 28 June 2018. 7 A transcript of the conference is available on the Commission’s website.8

[9] A report was subsequently issued by the Commission on 29 November 2019 containing proposed schedules of casual overtime rates. Interested parties were invited to comment on the proposed schedules.

[10] No objections were received in relation to the proposed schedules. We confirm that the Exposure Draft of the Mining Award will be amended to include schedules B.2.4 and B.2.5, as set out in the Report.

[11] In addition, the Annualised Wage Arrangements Full Bench issued a final variation determination on 12 February 2020 which varies the Mining Award with effect from 1 March 2020. This variation will be included in the final variation determination.

[12] We will issue a revised draft variation determination incorporating the amended schedules and the annualised wage arrangements provision on 19 February 2020. Interested parties will have until 4pm on Wednesday 4 March 2020 to comment on the revised draft. If no comments are received a final variation determination will be issued and will commence operation on 13 April 2020.
