JUSTICE MADDERN, PRESIDENT JUSTICE STANLEY COMMISSIONER LEARY MELBOURNE, 3 SEPTEMBER 1991
Hours of work - 38 hour week - agreement includes cost minimisation proposals - principles satisfied - award varied with effect from 16 August 1991.
DECISION
The following decision was issued in transcript at Darwin on 16 August 1991.
In this matter we are asked to consider an agreement between the parties to vary the General Clerks (Northern Territory) Consolidated Award 1985 to implement the 38 hour week. The parties have referred to the cost minimisation proposals, agreed to by them, and these proposals are referred to in the transcript of proceedings.
We are satisfied that the application of the Federated Clerks Union of Australia, agreed to by the employers' representative at these proceedings, meets the requirements of the National Wage Case principles. We are therefore prepared to make an order to give effect to their agreement. That order will be settled by the Registrar, with recourse, if necessary, to a member of this Bench. The order will come into force from the beginning of the first full pay period which commenced on or after 16 August 1991 and shall remain in force for a period of six months.
Appearances:
L. Matarazzo for the Federated Clerks Union of Australia.
K. Jackson for the Northern Territory Confederation of Industry and Commerce Inc. on behalf of the respondent members.
Date and place of hearing:
1991. Darwin: August 16.
