COMMISSIONER SMITH MELBOURNE, 20 JULY 1992

Hours of work - rostered days off - union sought variation to remove ambiguity when RDO falls on public holiday - employer consent - application granted.

DECISION

The following decision was given in transcript in Darwin on 8 July 1992.

This is an application to vary the General Clerks (Northern Territory) Consolidated Award 1985 to remove some uncertainty about the operation of rostered days off, in particular the provisions which ought to apply when a rostered day off falls on a public holiday and whether or not rostered days off can accrue and when they should be taken. The application is consented to by the respondents to the award. Accordingly, I shall vary the award.

The respondents seek seven days in which to check the precise terms of the order. Leave is granted for them to do so and if they could advise my office within that time if there is any alteration, otherwise the award shall be varied to commence from the first full pay period to commence on or after 8 July 1992.

Appearances:

L. Matarazzo for the Federated Clerks Union of Australia.

K. Jackson for the Northern Territory Confederation of Industry and Commerce and the Territory Construction Association on behalf of its respondent members.

Date and place of hearing:

1992. Darwin: July 7.
