Wage rates - review of Wage Fixing Principles October 1993 - arbitrated safety net adjustment principle - increase awarded.
DECISION
The following edited decision was given in transcript at Darwin on 14 February 1994.
This is an application by the Australian Municipal, Administrative, Clerical and Services Union (ASU) to vary the General Clerks (Northern Territory) Consolidated Award 1985 (the award) in accordance with the Review of Principles decisions of October 1993 [Prints K9700 and K9940].
The award concerned, although having received the benefit of all the increases available through national wage cases since 1989, has not as yet had all its classification structure reviewed notwithstanding that a $15 increase at each existing classification level was granted in November 1993 [Print L0196] and stated to be a first minimum rates adjustment.
At the time that that adjustment was granted, the parties indicated that they had agreed to the trialing of a classification structure based on that said to have been approved by the Western Australian Industrial Relations Commission. They said that this process would be undertaken in the early months of 1994. That process is still to be undertaken and I note that the ASU, on 21 December 1993, wrote to the Northern Territory Chamber of Commerce and Industry proposing that the trial, as agreed, should be undertaken.
On the basis of the information put before the Commission in this case, the Commission is prepared to further vary the award to insert the $8 per week safety net adjustment available under the October 1993 Review of Principles decisions. The variation to the award applying that adjustment will be in terms of exhibit M.2 in these proceedings.
The variation will come into force from the beginning of the first pay period to commence on or after today's date and will continue in force for a period of six months.
The Commission in granting this application also directs the parties to proceed forthwith in their negotiations on a new classification structure and, in particular, to proceed to the trialing to which they have already indicated agreement.
2 DECISION
The Commission further directs that the parties are to be in a position to report to the Commission the results of their trialing in the week commencing 10 May 1994 and, at that stage, the Commission would also expect the parties to be in a position to present their agreed views on a new classification structure, definitions, relativities and minimum rates adjustment.
