THE COMMISSIONER:  Thank you, Mr Turner.  Thank you.  This is a conference, a continuation of a series of conferences that have been before me regarding technical and drafting in the Children's Services Award.  I intend to proceed on the basis of the summary of submissions, technical and drafting that was circulated by the AMOD team on 19 April that I'm hoping the parties are all familiar with.  I intend to go through the items one by one to confirm each of the parties, either confirmation that what's been reported is accurate, and if not, to see if the matters that are still in dispute can be further narrowed between the parties.  Once that's done, I understand that there is also the substantive issues paper.  Hello?  Yes?

MR ROBSON:  Robson for United Voice.  This hasn't been agreed.  I think the position that we came to with AiG at the last conference was that this matter should be dealt with on the papers, but they're not here to confirm that today.  Perhaps the best way to deal with this is for the Commission to write to AiG to request if they want to make any further submission on this matter.  Certainly, United Voice doesn't think that there is any value to further discussions, that we'd be happy to deal with this by a submission.

THE COMMISSIONER:  So this is a matter, Mr Robson, that was put forward by AiG at the first instance that United Voice opposes, I take it?

MR ROBSON:  Yes, that's correct, and it has to do with the calculation of the casual rate and its interaction with the ordinary rate.

THE COMMISSIONER:  And there's a Full Bench dealing with those matters, is there not?

MR ROBSON:  A Full Bench has identified the principles which would be applied in dealing with this issue; however, I understand that there's no Full Bench dealing with this issue currently.

THE COMMISSIONER:  So the mechanisms in terms of how this matter will be looked at have been dealt with by the Full Bench?

MR ROBSON:  Yes.

THE COMMISSIONER:  And you're still opposing, and you would welcome a position in writing from AiG, is that - - -?

MR ROBSON:  Yes, I think so.

MR ROBSON:  They've said that they rely on their initial submissions on this matter.  We have filed submissions opposing that.  I'm not sure how they would want to take this issue further considering that was still in dispute.

THE COMMISSIONER:  Given that you're in dispute, isn't it for you to perhaps - I'm just not sure what the benefit of a further submission from AiG would necessarily be, unless you perhaps articulate what it is that you benefit from further in terms of your opposition.

MR ROBSON:  I suppose we have done so.  I'm only saying this out of fairness to a party that isn't present.  I'm not sure what their intentions are in this case.

THE COMMISSIONER:  All right.  So perhaps the best thing then, if that's the way you put it - and I'm not suggesting that that's not the way it is for a minute - is for the update to record that the matter's still in dispute, as far as United Voice is concerned.  Given that AiG is not here today though that the AMOD team will write to AiG asking the AiG to confirm what their position is in writing.  That then can be circulated to the parties in the interests of fairness and process.  Once that's done, then the parties would be asked to advise whether or not - the parties being you - - -
