[1] The following directions are made by consent of the principal parties:
1. The Australian Council of Trade Unions (the ACTU), on behalf of the union applicants, and any party or intervener in support are to file and serve on all other parties and interveners by 5 February 2003:
a) submissions in support of the applications;
b) affidavits of any witness evidence in support of the applications.
2. The submissions of all other parties together with affidavits of any witness evidence, are to be filed and served on parties and interveners by 26 February 2003 provided that, in the case of the retail motor industry, its submissions and affidavits shall be filed and served by 7 March 2003.
3. The ACTU is to file and serve any written reply on all other parties and interveners by 17 March 2003.
4. All other parties are to file and serve on the ACTU, interveners and each other any written response to the ACTU's written reply by 25 March 2003.
5. The ACTU may not file any written material after 17 March 2003 unless by leave of the Commission, which leave shall not be granted unless:
a) the material relates to economic data, academic studies or reports not available to the ACTU prior to that date; or
b) there are special circumstances which warrant the filing of such material.
6. No other party may file any written material after 25 March 2003 unless by leave of the Commission, which leave shall not be granted unless:
a) the written material relates to economic data, academic studies or reports which were not available to the opposing party prior to that date; or
b) there are special circumstances which warrant the filing of such material.
7. In making their oral submissions parties are to refer to all written material filed and served before the commencement of the proceeding.
8. There will be liberty to any party to apply.
[2] The Commission will sit in Melbourne on 31 March 2003, and 1, 2, 3 and 4 April 2003. Any cross-examination will occur on 31 March 2003. If no cross-examination is required the ACTU will commence its submissions on that day.
[3] Wherever possible submissions, affidavits and other materials should also be provided in electronic form by email to the following address: safetynet.review@air.gov.au. Provision of materials in electronic form is not a substitute for the normal hard copy filing and service requirements.
[4] So far as practicable all submissions, exhibits and other materials will be made available on a special page on the World Wide Web. That page is accessible through the AIRC Home Page under the description "Safety Net Review 2003". Information concerning the operation of the page and other matters can be found under the heading "Procedures for this Site".
