This policy sets out the Fair Work Commission's procedures regarding its enforcement powers under the Fair Work (Registered Organisations) Act 2009 (the RO Act) and the Fair Work (Registered Organisations) Regulations 2009 (the RO Regulations).
In particular, this policy sets out guidelines to be followed by the Commission in regulating employee and employer organisations that are registered under the RO Act (known as registered organisations).

This policy sets out the Commission's procedures regarding the General Manager's conduct of inquiries and investigations under the RO Act concerning the three possible offences involving auditors of employee and employer organisations that are registered under the RO Act.
The policy also provides information regarding the referral, as appropriate, to other investigating agencies of offences which come to the attention of the Commission but which it is not empowered to investigate.

In particular, it provides guidelines to be followed by the Commission in making decisions relating to the commencement of civil proceedings in the Federal Court of Australia under s.336(2) of the RO Act in relation to contraventions of the RO Act.
